I COMME NTS

  • The records identified on enclosed Appendices A and B are I

responsive to your request.

You may obtain copies of Appendix A records by contacting NRC's Public Document Room directly.

The records identif.

, on Appendix B are being withheld in their j

entirety.

As Nina Pugh explained to you in a

telephone 1

conversation on February 16, 1993, a protest was filed against this

[

awarded contract.

On November 9, 1992, a board decision was issued

[

regarding this protest.

The company filing the protest has 120 days within which to appeal the board's decision.

Therefore, until j

the 120-day appeal period has run, these records will continue to be withheld under Exemptions 4 and 5.

As Ms. Pugh informed you, you may submit a new FOIA request for the denied records after March 22, 1993.

You are not being assessed fees for the processing of your request since the minimal fee limit has not been exceeded.

l This completes NRC's action on your request.
