NOTICE OF ENFORCEMENT DISCRETION FOR WISCONSIN ELECTRIC POWER l
COMPANY REGARDING POINT BEACH UNIT 2 l
By letter dated April 9,1993, you requested the U.S. Nuclear Regulatory l
Commission (NRC) to exercise its discretion not to enforce compliance with the l
monthly reactor protection and safeguards circuit testing requirements speci-fled in Technical Specification (TS) Table 15.4.1-1 Item Nos.1, 4(1), 4(2),
5, 6, 7, 8, 11, 12, 18, 24, 25, 26, and 33 and TS Table Item No. 26(a).
You informed the NRC on April 8,1993, that Point Beach, Unit 2, would not be in compliance with TS Section 15.4, " Surveillance Requirements," on April 13, l
1993. Your request indicated a need for enforcement discretion based on the limited availability of baseload units and the potential for a localized degraded voltage condition to exist if Point Beach, Unit 2 were to be inadver-tently removed from the northeast Wisconsin power grid.
Your justification for continued operation included a review of reactor trip breaker performance and significant operating experience data related to instrument drift to assure instrument setpoints would not drift beyond the setpoint limits.
i Based on our review of your justification and the limited time this exercise l
of enforcement discretion is in effect, we have concluded that this course of action involves minimum or no safety impact, and we are clearly satisfied that this exercise of enforcement discretion is warranted from a public health and i
safety perspective. Therefore, it is our intention to exercise discretion not to enforce compliance with the aforementioned items contained in TS Tables 15.4.1-1 and 15.4.1-2 for the period from April 9,1993 to 14 days following the startup of the Kewaunee Nuclear Plant or Point Beach, Unit 1, not to exceed May 13, 1993. However, we will consider enforcement action, as i
appropriate, for the conditions that led to the need for this exercise of enforcement discretion.
