SUMMARY

OF MEETING OF APRIL 1, 1993 A public meeting was held between the Nuclear Regulatory Commission (NRC) and GE technical staff on April 1,1993, in the White Flint office of the NRC in Rockville, Maryland. The purpose of the meeting was to discuss the resolution status of several issues included in the draft final safety evaluation report (DFSER) for the ABWR related to the fuel design.

The enclosure lists the names and affiliation of those who attended the meeting.

The most significant issue discussed was the process by which new fuel designs would be adopted into the plant design vis-a-vis the Part 52 process.

Recently, the staff had indicated in discussions with GE that all future changes to the certified fuel design would need to be reviewed and approved by the staff even though the specific design information was included in the standard safety analysis report (SSAR) as Tier 2 information.

The staff indicated in the meeting that it was proposing a modified position to the Office of Nuclear Reactor Regulation (NRR) management, and it is as follows. The certified ABWR design will include important fuel design and performance criteria in Tier 1, and Tier 2 will include the detailed descrip-tion of the ABWR fuel design.

If the combined license (COL) applicant chooses the same fuel design in its application, no additional review will be required; however, if the COL applicant chooses to use a different design, the COL applicant will need to provide a topical report describing it and will need to modify the applicable SSAR sections to reflect its characteristics.

The staff will review this new information as part of the COL application, and this change to the design will be subject to litigation.

Subsequent changes to the fuel design in reloads,'as long as they fall within the criteria envelope included in Tier 1, will not require staff review and can be done under the normal process employed by operating plants using the GESTAR II Amendment 22 criteria. The staff stated that it would, upon management approval of the position, inform GE promptly and would modify the discussion in Chapter 4 of the final safety evaluation report (FSER) to reflect this new position. GE indicated that if the position is approved by NRR management, it would easily comply with the revised position and would reflect it the SSAR.

The staff indicated an observation that it had generally approved of the information which had been included in the Phase 3 Tier I certification material provided last July, but it had not seen the latest version of it.

GE staff stated that it would check on the status and content of the information for the fuel area.

Confirmatory Item 4.2-1 The staff expects two items to be included in the SSAR.

The first is a discussion of the analytical models which are to be limited to those refer-enced in GESTAR II, Revision 10, and any changes made to the models by a COL applicant would need to be approved by the NRC.

information in the SSAR. The second item is a statement that any increases in the fuel burn up limits beyond that in the certified design will require NRC review and approval.

GE indicated that it did not agree with this position.

The staff stated that its position is firm, and this requirement will also be imposed on current operating plant licensees generically and can be discussed in future owners group meetings with the staff.

Confirmatory item 4.2-2 Regarding the criteria for control rod designs, GE indicated that the informa-tion agreed to had been added to the SSAR and is in the revision process.

Confirmatory Item 4.2-3 The staff indicated in the DFSER that GE had committed to providing a refer-ence to NEDE-31756P in the SSAR to serve as a reference design.

GE clarified in the meeting that it would not specifically list the topical report as a reference, but instead would provide in the SSAR the design information extracted from that report. This was acceptable to the staff.

COL Action Item 4.4-1 The DFSER indicated that the COL applicant would need to provide a power flow map for each reload.

After discussions, it was agreed that the power flow map would be required for the original COL application but not necessarily for each successive reload. A revised map would be provided based on a 50.59 type evaluation. The staff agreed to change the wording in the FSER to reflect the agreement.
