MINUTES OF 386TH ACRS MEETING JUNE 4-5, 1992 i The 386th meeting of the Advisory Committee on Reactor Safeguards was held at Room P-110, 7920 Norfolk Avenue, Bethesda, Md., on June 4-5, 1992. The purpose of this meeting was to discuss and take appropriate action on the items listed in the attached agenda. The entire meeting was open to public attendance, with the exception of portions that dealt with the discussion of proprietary information related to the Simplified Boiling Water Reactor (SBWR) and selection of new Committee

members, and matters concerning discussions held with foreign representatives.

There were no written statements nor requests for time to ma}m oral statements from members of the public regarding the meeting. A transcript of selected portions of the meeting was kept and is available in the NRC public Document Room. (Copies of the transcript are available for purchase from Ann Riley & Associates, Ltd., 1612 K Street, N.W., Washington, DC 20006.) ATTENDEES ACRS Members: D. Ward (Chairman), P. Shewmon (Vice Chairman), I. Catton, J. Carroll, W. Kerr, H. Lewis, C. Michelson, J. E. Wilkins, and C. J. Wylie (Note: T. Kress did not attend any portion of this meeting.) I. Chairman's Report (Open) Note: Mr. R. F. Fraley was the Designated Federal Official for this portion of the meeting. Mr. D. Ward, ACRS Chairman, opened the meeting at 8:30 a.m. and mentioned the following matters: Westinghouse has provided an eight-foot model of the AP600 e design in Rockville for viewing. A DItC workshop will be held on July 20th at a downtown hotel (Washington, DC). t e Mark Stella, ACRS Fellow, will be attending a Canadian Nuclear Society meeting and giving a paper on value impact analysis. J. Carroll has been reappointed to the Committee, effective e June 1, 1992. The appointment of Bill Lindblad to the Committee has been approved by the Commission but the paperwork has not gone through the system. He has been invited to the July 1992 Committee meeting as a non-voting observer. Several new ACRS office staff members and summer interns were introduced.

The Committee reviewed the status of the test program being l conducted by GE Nuclear Energy (GE) in support of the certification ) effort for the SBWR design. Dr. Catton provided a Subcommittee Chairman's report to the Committee on this matter. Presentations were made by representatives of GE and the NRR staff. The key points noted follew. Subcommittee Chairman's Report Dr. Catton, Chairman of the Thermal Hydraulics (T/H) Phenomena Subcommittee, said that the Subcommittee held a meeting on June 2, j 1992 to continue its review of this matter. He noted that GE is .l using its own version of the TRAC code (TRACG) for its analysis of the SBWR design. GE intends to use the data from its various test j programs (GIRAFFE, GIST, PANTHERS, PANDA) to validate TRACG. ~ Dr. Catton noted that GE told the Subcommittee that they have conducted sufficient testing to support design certification. NRR disagrees and wants GE to accelerate the testing schedule for the large-scale (1/25) PANDA integral tests in order to support its SER i review. Additional testing at the GIRAFFE facility may also be necessary to support the staff's certification review. Dr. Catton said that the T/H Phenomena Subcommittee and consultants believe that GE needs to perform additional integral system tests, but at this time its not clear that the PANDA facility will supply the needed data. PANDA needs to be subjected to a rigorous scaling analysis. Closed Session - Proprietary Information Details of the GE Nuclear presentation and of the NRC staff presentation are contained in a Proprietary Supplement to these minutes. Conclusions The Committee issued a report to Chairman Selin, as indicated in Section XIII, providing comments on the GE test plan, and agreeing with the staff views that full-height, full-pressure integral i system testing is not needed. i

The Committee discussed a draft report provided to the Committee l for consideration by Mr. Ward. Conclusions l The Committee issued a report to Chairman Selin, as indicated in Section XIII, commenting on the implementation of the NRC Safety Goal Policy and a structure for more effective use of NRC resources and more effective regulation of the industry. IV. Generic Issue 23. " Reactor Coolant Pumo (RCP) Seal Leakace" (open) Note: Mr. P. Boehnert was the Designated Federal Official for this portion of the meeting. i Mr. Ward, Chairman of the Decay Heat Removal Systems Subcommittee, introduced this topi to the Committee, noting that the NRC staff requested an opportum ty to brief the ACRS. Mr. Ward also noted that the last time this issue was reviewed by the ACRS (September 1 1990), the Committee, via a memorandum to the EDO, endorsed the staff's intent to issue a proposed Generic Letter for public comment. Representatives of the NRC staff briefed the ACRS on the status of the resolution effort for Generic Safety Issue (GSI) 23, " Reactor. Coolant Pump (RCP) Seal Leakage." Key points note during this d discussion session include the following: The proposed Generic Letter was issued for public comment. e As a result of the comments received, the staff learned that 1) most utilities are treating the seals as safety-related equipment, 2) all who responded to the questions favored rulemaking to resolve this issue, and 3) no new in-plant data, seal failure models, or test data were supplied to the staff. j The staff believes a rule is needed, due in part to the e need to reduce the core damage risk seen for loss of all seal cooling events, and to avoid burdening licensees who are now " good performers," i.e., using proper maintenance of the RCP seals. j RES representatives discussed both the potential reduction 'l e in CDF expected from adoption of their proposed resolution I requirements and the associated value/ impact. ) 1 i

i 1 386th ACRS Meeting Minutes 4 l The proposed resolution for GSI 23 is to: (1) treat the RCP e seals as safety-related i: ems, consistent with the l strictures of Appendix b to Part 50, (2) utilize l manufacturer-recommended instrumentation and instructions for monitoring of seal performance and detection of i incipient failures, and (3) provide some sort of RCP seal cooling for off-normal conditions. The last requirement may be met by demonstration that a given licensee's seals can withstand loss of seal cooling for an extended period of time. Conclusions This was an information briefing. The ~ Committee deferred action on this topic until after the NRC staff has made.a recommendation l ~ regarding the selection of a regulatory vehicle for disposition of 4 this matter. V. Fitness-For-Duty Rule (Open) Note: Mr. H. Alderman was the Designated Federal Official for this portion of the meeting. i Mr. J.

Carroll, Chairman of the Human Factors Subcommittee, i

introduced the topic by noting that the discussion would concern i the proposed amendments to the Fitness-For-Duty Rule which the staff plans to issue for public comment in the near. future. The Commission, in a Staff Requirements Memorandum of November 7,1991, asked that the staff present the proposed amendments to the ACRS prior to submitting them to the Commission. NRC Staff Presentations Testina Rate Mr. B. Grimes, NRR, noted that the Sitness-For-Duty Rule was issued to become effective the beginning of 1990. The staff has now gained experience with the Rule and has found that~a balance is needed in Rule between the ability to detect and deter drugs and alcohol use and the protection of the rights of the individual. He noted that many of the provisions of the Rule are to make sure that t an individual is not unfairly treated. He said that during the first year the Rule was in existence, there were higher positive tests for contractor personnel than licensees. The overall random testing rate resulted in about 500 confirmed positive tests out of a total of 150,000 tests. He said that this number, about 0.4 percent of confirmed positive tests for nuclear licensees' workers, was relatively low compared to most industries in. the United l States. In response to a question from Mr. Carroll concerning how these resu ts compared to those in the nuclear Navy, Mr. Grimes said that r

i 386th ACRS Meeting Minutes 5 the overall Navy test results dropped from about 15 percent positive to about 5 percent positive in the early 1980s, and the percentage is thought to be lower now. He believes that the Navy positive tests are higher than the nuclear licensee positive tests. Mr. Grimes mentioned that the staff is collecting additional data and is considering lowering the testing rate. Policy Issues Mr. L. Bush, NRR, discussed the following policy issues that were raised in SECY-91-293: The National Institute on Drug Abuse (NIDA) has proposed changing their guidelines. These guidelines have been adopted as Appendix A to 10 CFR Part 26. The staff would like to keep Appendix A current with the NIDA changes. Many utilities only conduct drug testing during weekdays. Licensee's workers who work on weekends and back shifts are not tested on a random basis. One possible solution is to recommend random testing on weekends and backshifts. This issue is also concerned with tandom testing of workers with infrequent access. The staff has discussed this concern with representatives of NUMARC. They have told the staff that NUMARC would develop an industry standard to deal with this problem. l Drug testing is very cost intensive. Reducing the testing e rate while maintaining the deterrent would be worthwhile. i Uparade Chances i Mr. Bush noted that the staff has made the following changes to upgrade the Fitness-For-Duty Rule: The Rule requires that all workers that have unescorted access to the protected areas be tested. The staff has added that those people conducting the drug tests should be included. g Workers that have been absent from the site for more than 60 days are required to be subjected to a medical determination of fitness; however, the Rule wasn't clear as to whether this included a drug test - this has now been clarified to include a drug test. j A provision has been added to the Rule to extend the e appeals process to applicants. Previously this process was available to employees only.

t 386th ACRS Meeting Minutes 6 A provision has been added to test the specimens for pH e and specific gravity to help detect fraudulent samples. There have been instances of samples degrading between the e collection point and the testing laboratories. The staff has proposed shipping chilled samples. Procram Reductions Mr. Bush noted that the current Rule requires worker training and L refresher training at least once every 12 months. NUMARC has recommended changing this interval to 24 months. The staff is recommending a 14-month interval. The staff is also recommending that licensees accept workers' training from previous licensees, provided training was received during the previous 12 months. Some additional site-specific worker training would still be needed. l Mr. Bush said the staff is proposing that licensees can accept test results from other licensees, provided the worker has a clean record and has been covered by a fitness-for-Tuty program during the previous 12-month period. Mr. Bush noted that the current Rule requires an individual to provide two breath specimens that must be within 10 percent of each other. NUMARC and others have suggested that if a negative specimen is provided in the first breath test, then no further testing is required. The staff has adopted this recommendation. Chances Proposed by NIDA Mr. Bush noted that NIDA has proposed the following changes: Lowering the screening cutoff level for marijuana; e l Reducing volume of specimens to 30 ml e Eliminating batch. reporting; and I e Eliminating the permanent record book. o Chances Succested by NUMARC Mr. L. Bush noted that NUMARC had the following suggested changes: Limiting scope concerning emergency response personnel to e those whose decisions could directly affect public health 1 and safety; d Allowing workers unescorted access prior to receipt of test e results; Reducing random testing to 50%; e Permitting " alcohol only" for-cause tests; and Lowering cutoff levels for marijuana. e 1 i

Whitesel, NUMARC, commented on the following policy issues: A reduction in the tecting rate would save the industry money. l e NUMARC is willing to consider an NRC requirement for industry guidelines on specific topics, NUMARC believes the appeals process should be limited to e p employees. Mr. Enkeboll, NUMARC, said the reason NUMARC has suggested the " alcohol only" test was that workers suspected of alcohol abuse are now required to also take drug tests even if the alcohol test is negative. He said there wasn't any evidence that a negative alcohol test had any correlation with drug use. Committee Action The Committee issued a report to Chairman Selin, as indicated in i Section XIII, stating that it has no objection to the publication of the proposed amendments for public comment. VI. Certification of Evolutionary and Passive Plant Desians (Open) Note: Dr. M. El-Zeftawy was the Designated Federal Official for this portion of.the meeting. The Committee members discussed their individual responses to the so-called " Son of SECY Paper 90-016" policy issues that apply to i evolutionary and passive plant designs. Representatives of the staff and EPRI answered questions with regard to the following issues: i Proposed containment performance e Control room habitability e Fire protection e Pipe breaks inside and outside containment e Conclusions The Committee expects to consider this matter further at its July 9-11, 1992 meeting. Note: The staff provided the Committee with a Draft SER for Volumes I and III of the EPRI's Advanced LWR Requirements Document in SECY-92-133, dated April 14, 1992. The staff has identified policy issues for those times that it plans to depart from current regulations. Conclusions The Committee directed Mr. Fraley to send a memorandum acknowledging receipt of SECY-92-133 and to tell the staff that the Committee intends to schedule meetings as necessary to meet the established schedule. Igne was the Designated Federal Official for this portion of the meeting. 1 Dr. Wilkins, Chairman of the ACRS Subcommittee on Occupational and j Environmental Protection Systems, briefed the Committee on the results of the May 27, 1992 joint meeting of the ACRS Subcommittee on Occupational and Environmental Protection Systems and the ACNW Working Group. The meeting was held to discuss six proposed final i regulatory guides for the implementation of the revised 10 CFR Part 20 Rule. Of the six proposed regulatory guides reviewed during l this meeting, the ACRS has the lead responsibility for the following two guides: Regulatory Guide 8.7,, Revision 1, " Instructions for Recording e and Reporting Occupational Radiation Exposure Data" Regulatory Guide 8N6, " Planned Special Exposures" e Dr. Wilkins stated that with respect to the regulatory guides under ACRS review, no significant comments were proposed as a result of the joint meeting except that, during the May 27, 1992 meeting, the j ACRS Subcommittee /ACNW Working Group commended the staff for 1 performing a creditable job of dealing with extensive public j comments. Conclusions The Committee provided a report to Mr. James M. Taylor, Executive Director for Operations, as indicated in Section XIII, providing several comments and suggestions for staff consideration as the IPE develops. i X. Resolution of Generic Issue 81. Impact of Locked Doors and Barriers on Plant and Personnel Safety (Open) Note: Mr. H. Alderman was the Designated Federal Official for this portion of the meeting. Dr. Lewis, Chairman of the Safeguards and Security Subcommittee, reported on the resolution of this generic issue. He said that when the ACRS reviewed this issue, about two years ago, there were i errors in the mathematical analysis. The staff was requested to reanalyze this. issue. Dr. Lewis said that he didn't find any mathematical errors in the reanalysis. Conclusions The Committee directed Mr. Fraley to send a memorandum to the Director of Nuclear Regulatory Research, indicating that the committee has no objection to the revised analysis.
