l North Atlantic Energy Service Corporation (North Atlantic) submitted three topical reports for NRC review and approval on February 2,1993 [ Reference (b)]. The topical reports were prepared by Yankee Atomic Electric Company (YAEC) to describe core reload analysis methodologies which North Atlantic proposes to use in support of future operation of Seabrock Station l

North Atlantic requested that Yankee Atomic Electric Company (YAEC) Reports YA EC-1849 P, ' Thermal-Hydraulic Analysis Methodology Using VIPRE-01 for PWR Applications", YAEC-1854P " Core Thermal Limit Protection Function Setpoint Methodology for Seabrook Station

  • be withheld from public disclosure as they contain information proprietary to Yankee Atomic Electric Company. The affidavit of Stephen P.

Schultz, Vice President YAEC, was submitted in support of the request for withholding pursuant to 10 CFR2.790. A revised affidavit has been prepared by Mr. Schultz to address, more fully, the elements of 10 CFR2.790(b)(4). The revised affidavit of Mr. Schultz is enclosed herein. The enclosed affidavit dated March 29,1993, supersedes the affidavit of November 26,1992.

North Atlantic has also enclosed three Copyright Notices dated March 10, 1993, signed by Mr. Schultz, which grant the NRC the authority to make the number of copies of YAEC-1849P, YAEC-1854P and YAEC-1856P which are necessary for its internal use and to fulfill its legal responsibilities as regards public disclosure.

reviewed or caused to have reviewed the information which is identified as proprietary. I am submitting this affidavit in conformance with the provisions of 10 CFR 2.790 of the Commission's regulations for withholding this information 1

from public disclosure.

The information for which proprietary treatment is sought is contained in reports l

YAEC-1849P, " Thermal-Hydraulic Analysis Methodology Using VIPRE-01 for PWR Applications," YAEC-1854P, " Core Thermal Limit Protection Function Setpoint Methodology for Seabrook Station," and YAEC-1856P, " System Transient Analysis Methodology Using RETRAN for PWR Applications." These reports provide technical descriptions of analytical methods developed by the Yankee l

Atomic Electric Company.

Pursuant to the provisions of Paragraph (b) (4) of Section 2.790 of the Commission's regulations, the following is furnished for the consideration of the Commission in determining whether the information in the above report should be withheld from the public disclosure:

The information sought to be withheld from public disclosure is owned a.

and has been held in confidence by Yankee.

The information is of a type customarily held in confidence by Yankee and not customarily disclosed to the public. Yankee has a rational basis for determining the type of information customarily held in confidence which includes a procedure which determines whether to hold information in confidence. Under that procedure,information that is determined to have

would diminish Yankee's ability to sell products and services involving the use of this information.

The use of the information and data provided in this document by a competitor would put Yankee at a competitive disadvantage by reducing his expenditure of resources at the expense of Yankee and our sponsor companies.

Establish methods for calculating operating limits for reload cores.

(b)

Perform reload safety evaluations addressing the impact of the reload core 1

on the plant safety analysis.

Public disclosure of this proprietary information is likely to cause substantial harm to the competitive position of Yankee because it would enhance the ability of competitors to develop similar methodologies without commensurate expenditures. Also, public disclosure of the information would enable others to 1

use the information to meet NRC requirements for licensing documentation without purchasing the right to use the information.
