CONSUMERS POWER COMPANY - FITNESS FOR DUTY PROGRAM IMPLEMENTATION AND CERTIFICATION - AMENDilENT Title 10 of the Code of Federal Regulations, Section 26.73d, states in part that the certification of a licensee's FFD Program "shall describe ary licensee cut-off-levels more stringent than those imposed by this Part."
In reviewing our program it was noted that although our random alcohol test levels reflect the 0.040% cut off level indicated in 10 CFR Part 26, Appendix A, Subpart B, Sections 2.7(e)(1) and 2.7(f)(2), CPCo does invoke a more stringent cut-off level during testing other than random. This practice was not identified in our original FFD Program implementation and certification letter dated December 19, 1989.
CPCo's overall corporate alcohol policy states that action could be taken on any individual " evidencing the effects of alcohol." Fitness for Duty procedures state a reading between 0.005% and 0.040% must be immediately reported to program administrators to determine action.
For employees,
" action" is described in our corporate policy as " appropriate disciplinary action, which may include discharge." The exception being that, in the case of a first offense (0.040% or above) during random testing, an employee would have the option cf entering our Employee Assistance Service program. A contractor would either be denied unescorted access during pre-access testing or have access revoked during any other process. This information is contained in CPCo's FFD Policy for employees, CPCo's FFD Policy for contractors / vendors and is presented in our FFD all employee initial and requalification training.
Only one suitable inquiry was completed on an employee who tested below the 0.040% cut-off level following a For-Cause incident. The inquiry stated that although unescorted access was temporarily suspended, the denial was based on a level lower than 0.040%.
