SUBJECT:
NOTICE OF VIOLATION (NRC INSPECTION REPORT NO. 999-90001/93-01)
This refers to the inspection conducted by Mr. M. Fuller of this office on January 8, 11-13 and 20, 1993.
The inspection included a review of activities at your Ponce, Puerto Rico facility. At the conclusion of the inspection, the findings were discussed with you.
A Confirmation of Action Letter was also sent to you on January 8, 1993.
In that letter, we confirmed that you would immediately discontinue use of byproduct material and place it into locked storage, apply for a byproduct material license within 14 days (which you have done), leak test the sealed source prior to use or transfer of the source to another authorized user, and send the results to this office.
The inspection was an examination of activities related to radiation safety and compliance with NRC regulations.
It included selective examinations of procedures and representative records, interviews with personnel, and direct observations by the inspector.
Based on the results of this inspection, certain of your activities appeared to be in violation of NRC requirements, as.specified in the enclosed Notice of Violation (Notice).
You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. Although you promptly submitted an application for an NRC license and the NRC issued the license on March 25, 1993, your response should document the specific actions taken and any additional actions you plan to prevent recurrence of these violations and to ensure that you are fully knowledgeable of the applicable NRC regulatory reguirements for the safe use of licensed materials.
After reviewing your response to this Notice, including your proposed corrective actions and the results of future inspections, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.
If, in the future, the NRC finds that you are not in compliance with regulatory requirements, we will seriously consider issuing a civil penalty.
