NOTICE OF VIOLATION Northeast Nuclear Energy Company Docket No. 50-336 Millstone Nuclear Power Station, Unit 2 License No. DPR-65 During an NRC inspection conducted on February 3,1993 through March 2,1993, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is listed below:
Millstone Unit 2 Technical Specification 6.8.1 requires that procedures covering station activities be established and implemented. Station administrative control procedure ACP-QA-3.02, " Station Procedures and Forms," and procedure ACP-QA-2.02B, " Retests," were written pursuant to the above.
Procedure ACP-QA-3.02, step 6.1.6, requires, in part, that detailed station procedures and forms be prepared to address preventive and corrective maintenance and modifications which could affect the safety of the plant.

Procedure ACP-QA-2.02B, step 6.4.3, requires that if a retest fails and the component cannot be made to pass a subsequent retest in a short period of time, the component must be either safety tagged out of service or caution tagged indicating that it is not available to satisfy Technical Specification requirements. Step 6.4.4 requires that all deviations from acceptance criteria derived from design documents must be resolved by a properly dispositioned nonconformance report.
Contrary to the above:

On December 2,1992, a detailed station procedure was not prepared to address the revised local marking of the required valve position for high pressure safety injection throttle valve 2-SI-647. Operator misunderstanding of the revised valve position markings caused the high pressure safety injection system to be rendered inoperable on February 17, 1993.

From January 28 until February 2,1993, with the west vital 480 volt switchgear room coolers returned to service following a failed hydrostatic retest; no tags were hung indicating that the coolers were not available to satisfy Technical Specification requirements, and the retest deviation was not resolved by a properly dispositioned j
nonconformance report.

Pursuant to the provisions of 10 CFR 2.201, Northeast Nuclear Energy Company is hereby required to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, and if applicable, a copy to the NRC Resident Inspector within 30 days of the date of the letter transmitting this Notice of Violation (Notice). 'Ihis reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending the response time.
