April 5, 1993 Docket No. 50-333 Mr. Ralph E. Beedle Executive Vice President, Nuclear Generation Power Authority of the State of New York 123 Main Street White Plains, New York 10601

Dear Mr. Beedle:

SUBJECT:

RESPONSE TO GENERIC LETTER 92-04, " RESOLUTION OF THE ISSUES RELATED TO REACTOR VESSE!. WATER LEVEL INSTRUMENTATION IN BOILING WATER REACTORS" - JAMES A. FITZPATRICK NUCLEAR POWER PLANT (TAC NO. M84280)

This letter acknowledges receipt of your response to Generic Letter (GL) 92-04, dated September 29, 1992.

GL 92-04 was issued by letter dated 1

August 19, 1992, to all operating Boiling Water Reactor (BWR) Licensees.

GL 92-04 requested licensees to promptly assess the impact on their facilities l

of potentially erroneous level indication due to noncondensible gases, and to implement compensatory measures and long-term corrective actions as necessary.

We find acceptable:

l l

(1)

The Power Authority of the State of New York's (PASNY) review and acceptance of the BWR Owners Group (BWROG) generic analysis as being l

applicable to the FitzPatrick plant.

(2)

PASNY's endorsement of the BWROG commitment, outlined in its letter dated August 12, 1992, regarding schedule and plans for actions to address postulated errors in BWR water level instrumentation.

(3)

PASNY's implementation of plant-specific guidance to address all of the concerns identified in the BWR0G's Emergency Procedures Committee guidance letter dated August 19, 1992. This letter provides guidance for operator action in the event of level indication errors due to non-condensible gases during reactor pressure vessel (RPV) depressurization.

We also understand that you have sensitized your operators to these potential errors consistent with the BWROG guidance.

(4)

PASNY's commitment to implement modifications, if deemed necessary, to assure that the water level instrumentation is of high functional f

reliability.

Contrary to the schedule provided in your September 29, f

1992, letter, we request that you provide the NRC with a description of

i Mr. Ralph E. Beedle April 5,1993 the long-term corrective actions that you plan to implement at the FitzPatrick plant as well as an implementation schedule by July 30, c

1993.

The BWROG has approved refined operator guidance developed by the Emergency Procedures Committee for response to instrument errors due to noncondensible l

gases.

This guidance was sent to your staff on October 16, 1992. We feel i

that this guidance provides appropriate information for operators to adequately identify and deal with potentially inaccurate RPV level 3

instrumentation, and expect that this or equivalent guidance, has been incorporated into your station operations.
