Dear Ms. Shillinglaw:
i Your letter of January 29, 1993, to Chairman Selin, in which you asked a number of questions about dry spent fuel storage in independent spent fuel storage installations (ISFSIs), has been forwarded to me for response. Many of your questions were previously answered in a letter to you from Charles J.
Haughney, dated, March 17, 1993.
I will however respond to your question 1
about why we released proprietary material for the VSC-24 cask.
This action was taken to comply with the requirements of 10 CFR 2.790(c) of the Nuclear Regulatory Commission's regulations which provides, in pertinent part, that "information submitted in a rulemaking proceeding which subsequently forms the basis for the final rule will not be withheld from public disclosure by the Commission...."
The proprietary material, which the NRC staff relied upon for the approval of the VSC-24 cask, was made publicly available by placing it in NRC local public document rooms. We are not asking other vendors or any other particular party to review it. We are making it available to allow public access to all the information relied upon by the staff in conducting the rulemaking.
Many of your concerns are similar to other comments we received in the rulemaking process for the approval of the VSC-24 cask.
Because you previously commented on this rulemaking, you are on the list of those who will be receiving a copy of the Federal Reaister notice on the final rulemaking when it is published. All of the issues addressed in the public comments, along with NRC's responses, will be included in that notice.
