You are hereby authorized to commence work under the subject task order modification, effective February 17, 1993, with an established ceiling of

$76,887.00. The purpose of this modification is to allow for an additional level of effort, thereby increasing the total cost ceiling and extending the expiration date of the task order.

}

In accordance with Section G.5, Task Order Procedures, of the subject contract, this letter definitizes Modification No. I to Task Order No. 1.

This effort shall be performed in accordance with the enclosed Statement of Work and Energy Research Inc.'s technical proposal dated January 8, 1993, incorporated herein by reference.

As a result of the above, the expiration date for Task Order No. 1 is hereby extended from April 12, 1993 to December 31, 1993.

The total cost ceiling is hereby increased by 576,887.00 from $100,733.95 to 5177,620.95.

The total reimbursable cost amount is hereby increased by 571,523.00 from

$93,706.00 to 5165,229.00 and the fixed fee is increasv by $5,364.00 from 57,027.95 to $12,391.95.

The issuance of this task order modification does not amend any terms or j

conditions of the subject contract.

However, it should be noted that the e

contractor has submitted a request for an increase in indirect rates for performance of work during fiscal year 1993.

In accordance with Section G.1 - Indirect Cost Rates under the subject contract, the maximum l

allowable indirect cost rate for reimbursement of indirect costs is 43.43%

Overhead and 6.49% G&A.

Therefore, the contractor shall be reimbursed at the rate currently established under the basic contract.

In the event that i

the Defense Contract Audit Agency (DCAA) determines the contractor's l

indirect rates to be lower than the above established ceiling rates, the rates established by the cognizant DCAA shall apply and a modification to the contract will be prepared accordingly.
