COMSECY-93-007 AND COMGD-3 -001' BACKGROUND PAPER FOR REGULATIONS AND PRACTICE GOVERNING CITIZEN PETITIONS UNDER 10 CFR 2.206 FOR INSTITUTING PROCEEDINGS AGAINST LICENSEES In response to your memorandum of February.3, 1993, the Commission has no objection to OGC's proceeding with a public workshop generally as outlined in the subject SECY paper on the agency's approach to resolving issues raised in enforcement-type 2.206 petitions.

However, the Commission would urge OGC to be particularly sensitive to the possibility that the announcement might raise expectations which the Commission may not be willing to fulfill.

Consequently, the paper and the announcement of the workshops should be very carefully drawn to define the scope of this effort.

In particular, the exclusion of the subject of judicial review of enforcement-type 2.206 petitions from the discussion at the proposed workshop should be made clear.
