Nebraska Public Power District (EA 93-030)
Cooper Nuclear Station Docket No. 50-298 Subiect:
PROPOSED IMPOSITION OF CIVIL PENALTIES- $200,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalties in the amount of $200,000 will be issued on or about March 30, 1993 to the Nebraska Public.
Power District.
This action is based on two Severity Level III violations associated with: (1) providing inaccurate information to the NRC in response to a Notice of Violation, and (2) the failure to identify and correct a potentially significant condition adverse to quality, after the 1992 discovery of.a strainer that had been left in a safety system since initial startup.
For the first violation, escalation and mitigation factors were applied to the base penalty resulting in a civil penalty of $100,000.
Escalation of 50% was warranted because of NRC identification and escalation of 100% was warranted due to l'
licensee failure to act upon information which indicated that its submission was inaccurate.
Mitigation of 50% was warranted for previous good licensee performance regarding the accuracy of submitted information.
For the second violation, escalation and mitigation factors were applied resulting in a civil penalty of

However, escalation was warranted due to failure to act upon prior opportunities to identify the presence of strainers and poor licensee performance in the area of corrective actions.
It should be noted that the licensee has not been specifically informed of the enforcement action.
