EXEMPTION FROM 10 CFR 50, APPENDIX E, SECTION IV.F.2., REGARDING THE REQUIREMENT FOR ANNUAL EMERGENCY PLAN EXERCISES (TAC M85826)

On December 29, 1992, the staff granted a schedular exemption from the 1992 annual exercise requirement, approving deferment of the 1992 exercise to the first quarter of calendar year 1993.

In your letter of February 15, 1993, you requested an exemption to the requirement for an annual exercise of the Trojan Nuclear Plant Emergency Plan for 1992 that was scheduled for the first quarter of 1993.

We have completed our review of your February 15, 1993, request for an exemption from 10 CFR 50, Appendix E, Section IV.F.2, for 1992 and find it appropriate to issue an exemption on the condition that the plant does not resume operation. Should you decide to restart Trojan, the exercise must be conducted before the plant resumes operation.

The exemption permits you to suspend the annual training exercise required by 10 CFR 50, Appendix E, Section IV.F.2, on a one time basis for 1992.

Our conclusion is based on the defueled non-operating status of the Trojan Nuclear Plant, and your commitment in a letter dated February 17, 1993, not to move fuel back into containment without prior NRC approval.

On March 8, 1993, the staff received a revised emergency plan for the Trojan Nuclear Plant, called the Permanently Defueled Emergency Plan.

You state that this plan is commensurate with the risk associated with the facility in its current defueled and non-operating condition. The staff has begun review of your revised plan. We understand that you plan to exercise your Permanently Defueled Emergency Plan during calendar year 1993.
