NOTICE OF ENFORCEMENT DISCRETION FOR MILLSIDNE UNIT 2 TECHNICAL SPECIFICATION 3.4.10 REGARDING THE STRUCTURAL INTEGRITY OF THE SERVICE WATER SUPPLY LINE TO THE 480 VOLT VITAL AC SWITCHGEAR ROOM This letter refers to your staff's March 25,1993, telephone conversation with the NRC and followup letter, dated March 26,1993, in which you requested relief from the required l

actions in Technical Specification 3.4.10 at Milt. stone Unit 2. Specifically, discussions between the NRC and your staff during the week of March 22,1993, indicated that Unit 2 would not be in compliance with this TS regarding structural integrity due to a minor leak on a new socket weld on the service water supply line to the 480 volt vital AC switchgear room.

l Your staff provided as justification for continued operation that this leak was very minor,.

that it existed only at the ASME required hydrostatic test pretsure of 110 psig versus the normal system operating pressure of 38 psig, and that the weld porosity defect which allowed this leak did not affect the structural integrity of this line. In addition, your staffis currently 7

designing, fabricating and installing an " engineered clamp" to provide added assurance that i

the structural integrity of this line is maintained. Also, your staff will regularly inspect the

weld and could isolate the line if the weld failed. Existing procedures specify compensatory measures upon loss of cooling to the room. The installation of this clamp is expected to require approx.imately seven days to complete, during which time the NRC was requested to exercise enforcement discretion in this matter. This clamp will remain in-place until a permanent repair to the noted weld can be made during a future plant outage of 10 days or more scheduled on or before the next scheduled refueling outage at Unit 2.

Based on our review of your justification for continued operation including the compensatory measures identified above, we concluded that plant safety will not be compromised and we f

are satisfied that such action is in the best interest of public health and safety. Therefore, j

Region I elected to exercise discretion not to enforce compliance with TS 3.4.10 in this matter, and so informed Mr. J. Keenan of your staff during a telephone conversation at i

5:36 p.m., March 25,1993. This enforcement discretion will continue until you complete installation of the compensatory measure described, but no later than 5:36 p.m., on l
