Dear Mr. Chernoff:

The Nuclear Regulatory Commission staff has received the Department of Energy -

(DOE) January 1993 report entitled " Final Hydrogeologic Characterization of the Former Vitro Processing Site,. Salt Lake City, Utah." The NRC does not have a formal concurrence role for this type of report, but we understand that technical information in this document will support the Vitro Completion Report, which will receive NRC concurrence review.

Consequently, the following comments are provided for your consideration in preparing the draft Completion Report.

Ground-water is encountered at relatively shallow. depths (from about 5-to 12 feet deep) across the Vitro site. NRC staff is concerned that the i

contaminated ground-water on site may present a hazard to human health and the environment, if the property is released for unrestricted use 1

and site development includes deep foundations requiring construction dewatering.

We are confident DOE will adequately address-the ground-water contamination identified at the site,.as a part of DOE's Programmatic ~

l Environmental Impact Statement (PEIS) for ground-water restoration.

However, the NRC is concerned that the future land use and planned construction activities could adversely impact site access and any-potential active grgund-water restoration activities,:if such measures '

are required for. compliance with the EPA ground-water protection standards in 40 CFR 192.

We recognize that these and other. concerns of this type m'ust be evaluated on a case-by-case basis before' an individual site can be released'for unrestricted-NRC staff has raised similar issues at other Uranium Mill-Tailings use.

Remedial Action Project sites such as, Lakeview, Oregon and Riverton, Wyoming-

-L where other uses have been proposed for.the former processing sites before the:

i EPA ground-water standards have been met. We again emphasize DOE's need for

continuing management and control at the processing sites where the tailings have been removed and the sites are released before ground-water cleanup, as discussed at past NRC/ DOE management meetings. We anticipate that DOE will send a-letter to us in the near future addressing this-subject.
