NOTICE OF ENFORCEMENT DISCRETION FOR GULF STATES UTILITIES REGARDING RIVER BEND STATION By letter dated March 23, 1993, you requested relief from the required actions in Technical Specification 3.1. 4.2, " Rod Pattern Control System," to allow for continuous rod withdrawal of an individual rod to its original notch position after the rod was fully inserted by a manual scram from a partially inserted position; and Technical Specifications 3.10.2, "Special Test Exceptions - Rod Pattern Control System," and 3.1.3.2, " Control Rod Maximum Scram Insertion Times," to allow a control rod to be scrammed from a partially inserted position.

The purpose of this relief request was to allow performance of testing to help locate a leaking fuel rod.

Your staff indicated that the testing will be performed at approximately I

65 percent reactor power and would consist of individually scramming a control I

rod and then continuously withdrawing the control rod to return it to its original position. The relief from Technical Specification requirements is necessary to allow scramming of control rods that are not fully withdrawn and to allow continuously withdrawing the control rod to return it to its pretest j

position.

The licensee determined that bypassing the Rod Pattern Control System, required by Technical Specification 3.1.4.2 for this testing, does not pose any significant hazard to the health and safety of the public and will minimize the nodal power transient caused by the withdrawal of the control rod. Your staff also provided justification that the performance of this testing will be more conservative than testing under Technical Specification 3.10.2, since the rod pattern control system bypassed control rod will not be withdrawn past its pretest position and, thus, is less severe than that assumed in the safety analysis for scram insertion time testing.

Based on our review of your request and subsequent telephone discussions with your staff, we have concluded that plant safety will not be unduly compromised and we are satisfied that such action is in the best interest of the public health and safety. Therefore, it is our intention to-exercise discretion not to enforce compliance with Technical Specifications 3.1.4.2, " Rod Pattern Control System," 3.10.2, "Special Test Exceptions - Rod Pattern Control System," and 3.1.3.2, " Control-Rod Maximum Scram Insertion Times," as I(

i described in your request, for the purpose of conducting the testing. The relief is granted for a period of 7 consecutive days, beginning from the first use of the relief from these Technical Specification requirements, and in any case the relief is not granted beyond 8 p.m. on April 9, 1993.

This action is taken in accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, dated i

March 17, 1993.

This decision does not preclude the NRC from considering i

enforcement action for the conditions that led to the need for this Notice of Enforcement Discretion.
