This matter is before the Comission on a Motion by B. Irene Orr and D.
I. Orr (" Petitioners") to stay issuance of the full power license for Comanche Peak, Unit 2.
In their motion, petitioners allege that TU Electric " entered into restrictive settlement agreements with its co-owners...." Stay Motion at 3.
The Staff has previously reached a similar conclusion. Egg Letter from Thomas E. Murley, NRR, to William J. Cahill, Jr., TU Electric (January 12, 1993). However, the Staff did not address this issue in its response of March 22, 1993. The Comission would appreciate being advised by the Staff whether it has received responses to its January 12 letter and if those responses provide reasonable assurance that the employees and contractors of the former co-owners have been aware that they may bring safety concerns to the NRC. The Commission would also appreciate being advised of the status of the petition under 10 C.F.R. 52.206 filed by the National Whistleblower Center that raised this issue.
The Staff's response should be in the Comission's hands by the c.o.b. on Tuesday, March 30, 1993 and should be served on other parties to the proceeding by facsimile transmission. Any other party who 9304020122 930326 ADOCK 0500 6
