I In the Joint Progress Reports to the Atomic Safety and Licensing Board dated January r

15 and March 15,1993, the parties to the captioned licensing proceeding informed the Licensing Board that the NRC. Staff now projects a five-month delay in the publication' date for the,Claiborne Energy Center's Safety Evaluation Report (SER) (three months j

delay reported in January and two months added in March) and a three-month delay for publication of the Final Environmental 1mpact Statement (FEIS). As you can

understand, these delays are seriously disappointing and they underscore the need for a

concerted effort, on both of our parts, to meet the currently projected Staff dates of J

September 9,1993, and August 16,1993, for issuance of the SER and Draft EIS, respectively.

j Staff review of the LES application for the CEC project has been ongoing since.fanuary

.l 1991. - Numerous NRC requests have been made for additionalinformation and,'

j recognizing that complete and timely answers are necessary to maintain the NRC review '

j schedule, LES has made every effort to meet its submittal responsibilities despite some

- unavoidable _ delays. While the question and answer process inevitablyintroduces some

.j delay into the schedule, we do not believe that all of the delays thus far are solely a result of the timeliness of LES answers. We urge the Staff to maintain adequate o

resources committed to this proceeding. Sufficient information has now been provided to t

r Mr. John Hickey March 23,1993 Page 2 enable the Staff to complete its tasks on the schedule projected. To the best of our knowledge, only the following information and issues related to the completion of the NRC staffs SER and Draft EIS remain outstanding.

LES submitted a revised Criticality Safety Engineering Report (CSER) on e

March 15,1993, except for one sub-analysis which will be submitted by March 31,1993,in response to requests for additionalinformation dated December 23,1992, concerning the CSER.

By March 31,1993, LES will submit seismic and accident analysis e

information, including classification of stnictures, systems, and components, n

in addition to the information supplied in LES' responses dated December 10,1992.

The NRC staff is reviewing plans, detailed in LES' letter to the NRC dated December 14,1992, for the depleted uranium hexafluoride that will be produced at the Claiborne Enrichment Center.

The NRC staff is reviewing LES' revised Emergency Plan, submitted on January 29,1993, in response to requests for additionalinfonnation dated November 20,1992. Minor corrections and clarifications will be made to the Emergency Plan as discussed with Dr. L Roch6 on March 11,1993.

The NRC staff is reviewing LES' revised License Application Section j, e

submitted March 10,1993, which increases the nuclear liability insurance amount to be carried by LES from $120 million to $200 million.

The NRC staff is reviewing LES' revised Fundamental Nuclear Material Control (FNMC) Plan, submitted on February 26,1993, in response to requests for additionalinformation dated August 14 and 17,1992.

It is our view that none of the outstanding information is sufficiently vital to warrant further postponement of the entire review process pending receipt from LES. If this is not the Staffs view, or if you note any additionalinformation or issues that remain t
