REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE V0GTLE ELECTRIC GENERATING PLANT UNITS 1 AND 2 By WCAP-13377,Rev 2 & Proprietary WCAP-13376,Rev 2, Bypass Test Instrumentation for Vogtle Electric..., encl.WCAP-13376,Rev 2 Withheld|letter dated March 1,1993]], Georgia Power Company (GPC or licensee) submitted application for amendments to License Nos. NPF-68 and NPF-81 revising the Technical Specifications regarding the surveillance test intervals and allowed outage times for engineered safety features actuation system instrumentation. The licensee submitted Westinghouse WCAP-13376, Revision 2, " Bypass Test Instrumentation for the Vogtle Electric Generating Plant Units i and 2" which details the design modifications associated with the capability to " test in bypass" associated with the amendment proposal.

WCAP-13376 is marked " Westinghouse Proprietary Class 2."

The submittal also includes WCAP-13377, Revision 2, which is a redacted, non-proprietary version of WCAP-13376.

Since WCAP-13376 contains information proprietary to Westinghouse, the licensee requests that the information be withheld from public disclosure in accordance with 10 CFR Section 2.790 of the Commissions regulations.

In support of the request for withholding the proprietary information from public disclosure, Westinghouse submitted application and affidavit dated January 18, 1993, based on the following:

a.

The information reveals the distinguishing aspects of a process (or component, structure, tool, method, etc.) where prevention of its use by any of Westinghouse's competitors without license from Westinghouse constitutes a competitive economic advantage over other companies.

b.

Its use by a competitor would reduce his expenditure of resources or improve his competitive position in the design, manufacture, shipment, installation, assurance of quality, or licensing a similar product.

We have reviewed Westinghouse's application and the material based on the-requirements and criteria of 10 CFR 2.790 and, on the basis of Westinghouse's statement, have determined that the submitted information sought to be withheld contains trade secrets or proprietary commercial information.

Therefore, the proprietary information will be withheld from public disclosure pursuant to 10 CFR 2.790(b(5) and Section 103(b) of the Atomic Energy Act, as amended.

If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC. You should also understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information.

In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
