NRR/PRPB REVIEW 0F PROPOSED NOTICES OF VIOLATIONS OF NEW PART 20 In a January 8, 1993, memorandum, Jay Cunningham informed the Branch Chiefs in your Divisions who are responsible for radiation protection inspections at power reactor facilities that proposed violations of 10 CFR 20.1101(b) (the ALARA requirement of new Part 20) should be submitted to the Radiation Protection Branch (PRPB), NRR, for review.
I have decided to extend this PRPB review to all proposed violations of new Part 20 (10 CFR 20.I001-20.2401) in order to better ensure a uniform implementation across the Regions.
Effective immediately, all proposed violations and non-cited violations proposed for inclusion in inspection reports that relate to new Part 20 (10 CFR 20.1001-20.2401) by power reactor licensees should be submitted to PRPB for review. Violations of other regulatory requirements (e.g., technical specifications and other parts of NRC regulations) need not be submitted for review.
To minimize administrative burdens and turnaround times for these reviews, the Region should E-mail or fax the draft Notice of Violation and supporting background information (including pertinent sections of the inspection report) to Jay Cunningham, Chief, PRPB.
PRPB will try to provide its feedback to the Region (either by telephone or E-mail) within 2 to 3 working days of receipt unless more extensive coordination is required among other Headquarters offices. A teleconference will be used on an as-needed basis.

PRPB/NRR concurrence on the final notice of violations will be provided only if requested by the Region.
PRPB will distribute information on the results of these interactions to all Regions, NMSS, and OE on a timely basis.
These PRPB reviews of new Part 20 violations will be continued at least through the first six months of 1994.
