IMPOSITION OF CIVIL PENALTY - $8,000 By EN 92-100 dated December 21, 1992, the Commission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $8,000 to Western Technologies, Inc., Phoenix, Arizona.
This action was based on the willful failure to wear alarm ratemeters when performing i
radiography in NRC jurisdiction, which was classified at Severity Level II.
The licensee responded to the Notice in a letter dated January
'6 26, 1993.
In its response, the licensee admitted the violation but requested full mitigation of the proposed penalty.
After careful consideration of the licensee's response, the staff has concluded that the licensee failed to provide a basis for any mitigation of the civil penalty amount.
Accordingly, an Order Imposing Civil Penalty in the amount of i
$8,000 has been issued today.
Under the terms of the Order, the licensee may pay the civil penalty or request a hearing within 30 days of the date of the Order.
