SUBJECT:
ALLEGED DISCRIMINATION AGAINST AN EMPLOYEE FOR HAVING ENGAGED IN PROTECTED ACTIVITIES This refers to your letter dated February 5,1993, in response to ourl letter -
dated January 7,1993, concerning the alleged discrimination of a former employee of Wackenhut Corporation, a contractor to Entergy Operations,-Inc., at Waterford-3 in Killona, Louisiana.
This individual filed a complaint with the U.S.
Department of Labor's Wage and Hour Division in New Orleans, Louisiana, on July.
30, 1992, alleging that his employment at Waterford-3 was terminated as a result of his engaging in protected activities, i.e, he had raised _ concerns ' about '
certain " crucial task" training records.
The NRC's January 7,1993, letter asked Entergy to provide the basis for the employment : action involving this individual and to describe actions taken or planned to assure that this employment action.did not have a chilling effect on the willingness of other' licensee or. contractor employees to re,2e perceived safety concerns.
After reviewing the information provided and the circumstances of this case, we have determined that enforcement action will not be taken.
The NRC considers this matter closed.
No response to this letter is required.
In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter will be placed in the NRC Public Document Room.
