ASLBP No. 93-671-01-OLA-3 PETITIONERS SCHEDULING STATEMENT Introduction On or about February 23, 1993, counsel to Petitioner, Allen Mosbaugh, contact John Lamberski, counsel to Georgia Power Company.

Mr. Lamberski was not interested in establishing discovery dates and advised the below-signed that he would be filing an appeal of the Board's February 18, 1993 Order.and would seek a stay of all discovery.

Earlier that same day below-signed counsel spoke with Charles Barth, counsel to Staff, who indicated that he believed he could accommodate any reasonable established discovery schedule reached by the parties.

Discovery from Georcia Power With respect to discovery from Georgia. Power Company, Petitioner-anticipates the need to conduct one and a half weeks of depositions in the Birmingham, Alabama. area;-one week of depositions at the Plant Vogtle site; and one week of depositions-1 9303220130 930308 PDR ADOCK 05000424 0

at GPC's corporate offices-is Atlanta.- Petitioner would'like[to commence depositions as soon.as possible (excluding the'veeks of' March 15, 1993 and March 22, 1993 due to conflicting schedules).

Petitioner also anticipates serving subpoena duces' tecum and.

a requests for documents.

Discovery from Sources Within the NRC With respect to discovery from sources within-the NRC, petitioner will address that issue in his March 18, 1993 filing-in response to NRC Staff's brief.

Future Date to Discuss Schedulina Petitioner suggest that a conference between the parties and-t the Board occur on or about' April 1, 1993.

At that time petitioner should be able to discuss scheduling matters relating to a hearing, and other prehearing matters.
