HoTION tor CONTINUANCE TO FILE BRTRP On March 4, 1993, counsel to Georgia Power Company filed, via overnight delivery, an appeal and a motion to stay pending appeal of the February 18, 1993 Memorandum and Order of the Atomic Safety and Licensing Board.
Pursuant to 10 C.F.R.
SS 2.710 and 2.714a, Petitioner's brief in response to GPC's appeal and request for a stay is due on March 16, 1993.
On the afternoon of March 5, 1993, the Nuclear Regulatory Commission (" Commission"), without prior notice served, via facsimile, an order in Texas Utili_ ties Electric Co.'(Comanche Peak Unit 2), Docket No. 50-446-CPA, requesting below-signed counsel.to file, by close of business on March 12, 1993, a brief addressing qucctions raised in the Commission's order of March 5, 1993.
As requested, on March 12, 1993 below-signed counsel filed a brief in response to the Commission's March 5, 1993 Order.
Thereafter, a blizzard struck the Washington,.D.C. area, prohibiting Petitioner's counsel from commencing legal research necessary to respond to GPC's appeal and motion to stay.
