SUBJECT:

ALLEGED FALSIFICATION OF DEC0 REPORT TO NRC On January 29, 1993, the NRC Office of Investigation (01) issued its report of an allegation made by a former contract employee who was employed at the Detroit Edison Company (DECO) Fermi 11 Power Plant. The allegation was that-Fermi 11 security management personnel deliberately provided' false and misleading information in response to an NRC request for information. The OI investigation revealed that DECO did not deliberately provide false and misleading information in response to the NRC request for information.

As a result of our review of the subject report, we have determined that there are no regulatory issues and we have no further questions. A copy of the 01 Report Synopsis is enclosed for your information.

No response to this letter is required.

In accordance with 10.CFR 2.790 of the Commission's regulations, a copy of this letter will be placed in the NRC Public Document Room.

SYNOPSIS-On September 18,,1992,- an investigation was initiated by the U.S. Nuclear. Regulatory Commission-(NRC), Region -III~ (RIII),

Office of Investigations (OI), concerning an allegation made by a former contract employee who was employed at the Detroit Edison Company (DECO), Fermi II Power Plant (Fermi II).

The employee alleged that DECO Fermi-II Security management per-sonnel deliberately provided false and misleading information in response to an NRC request for information.

Specifically, the alleger claimed as false the DECO report to the NRC which stated that the witness who instigated a search by security personnel of the alleger was not friends of the security personnel.

The alleger claimed that the witness, in fact, was-friends with.the security personnel.- The alleger also claimed -that the initial-follow-up investigation conducted by a DECO investigator of the-

incident involving the search of the alleger, was deliberately i

limited by a senior DECO Fermi II Security manager ~1n an effort i

to preclude a thorough investigation.. Finally,-the alleger

claimed that a second subsequent investigation by DECO Quality Assurance (QA) audit personnel which stated that-the previously mentioned witness did not contact security prior to the search of the alleger,.was false; that the witness did, in-fact, contact-security prior to the search of the alleger.

The nl. investigation revealed that DECO did not deliberately I

provide false and misleading information in response to an NRC request for information.

The.OI investigation revealed that.

i DECO Fermi II Security personnel involved in the. search of the alleger were not friends of the witness who-instigated the search of the alleger.

The investigation further revealed that the DECO Fermi II investigator who conducted'the initial follow-up investigation of the incident involving the search o' the alleger was neither influenced nor limited in the scope of his investigation by any senior DECO Fermi II Security managers.

The OI investigation also substantiated that the witness, who instigated the search of the alleger,.did have prior contact with the DECO Fermi II Security manager.

Finally, the inves-tigation revealed that the witness, who instigated the search of the alleger, and contacted DECO Fermi II Security before the search, deliberately provided false information to the DECO auditor during the second DECO Fermi II investigation of the incident.

The OI investigation determined that the DECO report submitted to the NRC regarding the witness did not deliberately contain any known false information.
