Dear Mr. Mallory:

I am responding to your letter dated November 16, 1992, regarding Invoice No.
AM07274-92sfor License No. 50-23523-01.
You state in your letter that:
(1) you.did not want'NRC services, and elected
i
to sell your gauge and let .us tcminate your license; (2) you received
unexplained bills for fees that amounted to more than the value of your gauge,.

along with warnings that if it was not paid, your license would be terminated,
which is what you wanted anyway; and (3) you have no intention of paying the
invoice.

The final rule revising 10 CFR Part 170 and 10 CFR Part 171 provided an '
opportunity for licensees who wished to relinquish their licenses and who vere
.
capable'of permanently ceasing licensed operations by September 30, 1991,.to-
'
avoid the FY 1991 annual fee if the licensee notified the Commission in .
.
writing within the 30-day period prior to the effective date of the rule-
(56 FR 31475'and 31485; July 10, 1991). As stated.in the Federal Register-
,
notice,-and the notice which was mailed with the invoice, the. effective date
!
'
of the rule was August 9,1991.

As stated in the final. revision to the Commission's fee regulation's in 10 CFR Parts 170 and 171 for FY 1992, which was published in the Federal Register
a
July 23,1992, the Commission exempted from .th.e FY 1992 annual fee those
licensees and holders of certificates,' registrations and approvals who either
filed for termination or for a paisession only/ storage license during the.
period October 1, 1991, through December 31, 1991.
A review of the files shows that License 50-23523-01 was terminated on
September 25, 1992, on the basis of informatjon obt.ained on September 17,

1992. The background information pertaining to the termination indicates that
i
during the week of July 29 - August 1,1991,'an NRC inspector.' attempted to
conduct an inspection of your licensed activities but was unable to contact
you. 'The inspector determined that your business phone was no longer in . . .
'
service and that it appeared you sold.your business and may no longer own.the
licensed material. Another inspector was able to reach you the week of
September 14, 1992, at which time you ir. formed him that you sold the gauge in '
1990 and did not want.an NRC license and questioned why NRC was still-
contacting you-about that license. The inspector explained that you had never

requested that the license be terminated.
In a telephone conversation with:

the inspector on September 17, 1992, you stated you wished to terminate the'
license.

Based on the above and the information provided in your November 16, 1992,
letter, the Commission:- (1) grants an extension to the time .to file for
termination to September 17,.1992; (2) acknowledges that you disposed of
licensed material in 1990; (3) consid~ers your acti6ns timely for purposes of
avoiding the FY 1991 and FY.1992 annual fees; (4) acknowledges that License
50-23523-01 was terminated September 25, 1992; and (5) rescinds the Order
~
Revoking License date October 23, 1992.
Invoice Nos. AM08667-91 and AM07274-92 have been cancelled.
