Dear Administrative Judges:
As you are aware, counsel for the licensee in this proceeding, Northeast Nuclear Energy Company (NNECo), had planned.
to take the deposition of-Dr. Michio Kaku yesterday in New York City.
- However, in endeavoring to do so,. NNECo's counsel was diverted to Boston while in transit from Washington, D. C.
to -
New York due to bad weather at LaGuardia Airport in New York.
LaGuardia was closed throughout. the morning and did not reopen-until too late in the day to allow the deposition to go forward.
Therefore, while Dr. Kaku, Ms. Marucci, and NRC Staff counsel were available, the deposition had to be cancelled.
We will be working over the next few days with 'the parties and Dr. Kaku to reschedule the deposition. We will apprise the Licensing Board of the new date as soon as one is established.
