DPR-42 50-304 DPR-60 Response to Notice of Violation 92029 Failure to Submit Licensee Event Report Within 30 Days Your letter of January 26, 1993, which transmitted Inspection Report No. 50-282/92029 (DRP) and 50-306/92029 (DRP), requested a response to Item B in the Notice of Violation.

The following is offered in response to that request.

Violation The Licensee Event Report rule (10 CFR 50.73) requires in paragraph 50.73(a)(2)(1) that licensees report any operation or condition prohibited by the plant's Technical Specifications (TS) within thirty days after discovery of the operation or condition (event).

The two fire doors between tne control room and the records room, and the control room and the study area were blocked open from November 29, 1992 until December 20, 1992. Having two control room fire doors open without establishing an hourly fire watch within one hour of opening the doors was a condition prohibited by the plant's TS.

Discovery of the event and establishing an hourly fire watch occurred on December 4, 1992. The thirtieth day after the discovery of the event was January 3, 1993, but since that was a Sunday, the report was allowed to be mailed l

on the next working day, January 4, 1993.

Contrary to the abnve, as of January 4,1993, the licensee had not reported that the two control room fire doors had been ope:

thout establishing an hourly fire watch within one hour.

This is a Severity Level V Violation (Supplement I).

-USNRC February 25, 1993 Page 2 Reason for the Violation On November 29, 1992, both units were at cold shutdown.

The fire door between the Control Room and the Records Room, and the fire door between the Control Room and the operators' Study Area, had been blocked open to provide some cooling for those rooms while their normal cooling system was out of service due to cooling water header replacement. No compensatory measures had been taken.

It was believed that since the Control Room side of the fire doors is continuously occupied by qualified fire brigade members, a fire watch was unnecessary. Following discussions with Region III personnel, it was decided that this was a Technical Specification violation.

Due to personnel error, we failed to report this Technical Specification violation.

Corrective Steps Taken and Results Achieved The event was repprted as Unit 1 LER 93 001.

Corrective Steps to Avoid Further Violations A letter will be issued to all appropriate site personnel discussing the necessity of forwarding reportability decisions to proper levels of management. This letter will be issued by. arch 15, 1993.

Date When Full Compliance will be Achieved Full compliance has been achieved.

In summary, we believe this problem will not happen in the future.

This letter contains no new NRC commitments.
