NEW SAFETY REQUIREMENTS FOR RADIOGRAPHERS On January 10, 1990, the NRC published a final rule in the Federal Register (55 FR 843), establishing additional safety requirements for industrial radiography equipment (10 CFR Part 34). Effective January 10, 1992, the rule requires that all newly manufactured radiographic exposure devices, sources, and associated equipment acquired by the licensee after January 10, 1992, must comply with the requirements described in Section 34.20. Further, all radiographic exposure devices and associated equipment in use after January 10, 1996, must comply with the requirements described in 10 CFR Part 34.20.
We are enclosing a listing of radiographic equipment that currently complies with the equipment rule as of January 10, 1992.
(SeeEnclosures1and2) All radiographers who are working under reciprocity are expected to ensure compliance with these new NRC requirements.
Please note that the final rule also modified the NRC Enforcement Policy (10 CFR Part 2, Appendix C, Supplement VI) to include an example of a Severity Level III Violation for failure to have present or use radiographic equipment, radiation survey instruments, and/or personnel monitoring devices (including ALARMING RATEMEMFTERS) as required by Part 34. A Severity Level III Violation can lead to a civil penalty (monetary fine) or other appropriate enforcement action.
In addition to the above please be advised that in order to transport your device you must have a Quality Assurance Program that is approved by the NRC.
10 CFR 71.12 provides for a general license to transport, or to deliver to a carrier for transport, licensed material for whid a license, certificate of compliance, or other approval has been issued by de NRC. However, the i
general license applies only if you have a quality assurance program approved by the NRC (as specified in 10 CFR Part 71.12(b)) and the conditions specified in 10 CFR 71.12(c) and (d) are met. The attached copies of Regulatory Guide 7.10 and 10 CFR Part 71 may be helpful to you. A fee for evaluation of Part-71 Quality Assurance Programs as-specified in Section 10.F in 10 CFR 170.31 must accompany your request for Quality Assurance Progra:a Approval.
