Dear Mr. Hunt:

I am responding to your February 2,1993, letter to Chairman Selin concerning the proposal to store spent fuel at the Palisades Nuclear Power Plant.

In your letter you requested that the Nuclear Regulatory Commission hold a Public hearing on the issue.

The matter before the NRC is a proposal to approve a specific cask design, the VSC-24 design by Pacific Sierra Nuclear, for use at any nuclear power plant site in the country. Generic approvals of casks, such as we are considering for the VSC-24, are conducted through rulemaking proceedings and not public hearings as in the normal licensing process.

In fact, through the Nuclear Waste Policy Act of 1982, Section 133(a), Congress directed that the NRC conduct such generic reviews without public hearings.

We are treating your request as a comment in the ongoing rulemaking and will publish our conclusions and resolution of comments received in the Federal Register when the rulemaking is complete.
