REQUEST FOR EXEMPTION FROM 10 CFR 55.35 2-MONTH REQUIREMENT FOR SECOND APPLICATION FOR EXAMINATION On November 23, 1992, Region 11 of the U.S. Nuclear Regulatory Commission (NRC) received your application for a senior operator licensing examination to be administered at the Browns Ferry Nuclear Plant in December 1992.
In your application on Form 398, you requested an exemption of the eligibility t
requirement in Section 55.35(a) of Title 10 of the Code of Federal ~Reaulations (10 CFR 55.35(a)) to wait 2 months from the date of denial of your first application before submitting a second application.
The final denial of your first application did not become effective until I
October 21, 1992. Therefore, the 2-month waiting period requirement of'IO CFR 55.35(a) does not allow you to apply for a second examination.until December '
21, 1992. However,10 CFR 55.11 allows the Commission to grant exemptions from the requirements of 10 CFR Part 55, either upon application by.an interested individual or upon its own initiative, if it determines such exemptions are authorized by law, will not endanger life or property, and are otherwise in the public interest.

Since a major simulator outage will begin on December 18, 1992, no opportunity to reexamine you will exist until September 1993, the next scheduled examination at Browns Ferry. Administering a separate individual simulator i
examination to you between the end of the simulator outage and' September 1993 l
to satisfy the 2-month reapplication requirement of 10 CFR 55.35(a) would require the region to use examiners in an inefficient manner.
Since Region II will be on-site the weeks of November 30 and December 7, it would be efficient utilization of NRC resources to conduct the reenmination during that visit.

The NRC has considered your request, the limited scope of your reexamination, and the supporting documentation that delineates the preparation and training-that you have received since your last application._ The NRC has determined that granting you an exemption from the-requirements of 10 CFR 55.35 will not endanger life or property and is otherwise in the public interest. Therefore, the NRC grants you an exemption from the 2-month waiting period delineated in i

and accepts your application for a senior operator licensing examination to be administered at the Browns Ferry Nuclear Plant in December 1992.

portion of the operating test is also granted.
