Power Plant and Environmental Review Program, (hereinafter referred to as " State"), by and through its attorney, M. Brent i

Ilare, hereby moves pursuant to 10 C.F.R. $2-711 to extend the procedural schedule established by Memorandum and Order dated Apr11 4, 1990 and extended by Memorandum and Order dated Apr11 30, 1990.

In support of its Motion, the State says:-

FIRST, the State was granted standing to intervene in this proceeding by a Memorandum and Order of the Atomic Safety and Lloensing Board on April 4, 1990.

SECOND, the Memorandum and Order of April 4, 1990 required the filing of contentions by the Stato on Monday, April 30, 1990-GRANTED For the Licensing Board' i

and the filing of responses by the appiloant, BO&E, and the NRC Staff on Wednesday, May 16, 1990. It also scheduled a prehearing, conference for Wednesday, May 23, 1990,

t THIRD, on April 26, 1990, the State filed a motion seeking a l

i one week extensjon of filing dates which were set forth in the Memorandum and Order dated Aprl! 4, 1990.

The purpose of seeking l

an extension was to allow the State time to reacn a stipulation j

with the Applicant and the Staff under which the State would i

withdraw its Petition.

On the same date, the State faxed copies i

of a proposed Stipulation to the Staff and to the Applicant.

FOURTil, the Licensing Board, acting by und through the 1

lionorable Charles Dechhoofer, Chairman, granted the State's request and extended the time for the State's filing of l

contentions until Monday, May 7, 1990.

The date for filing responses to the State's contentions was also extended one week.

FIFTH, Although the State met with counsel for the applicant on Tuesday, May 1, 1990 and has contacted Staff for comments and proposed changes to the draft stipulation, the parties have been t

unable to concludo an ar.'ecment as yet.

Although we expect to-finalizo an agreement by the end of next week it is necessary to request an additional extension.

SIXTil, Counsel for Nuclear Regulatory Commission's Staff and Daltimore Gas and Electric Company have indicated that they.have l

no objection to the requested extension.

THitREFORE, it is hereby requested that the dates for the State's filing of contentions be extended until Monday, May 14, 1990 ano the filing of responses by Daltimore Gas and Electric Company and NRC Staff be extended until Wednesday, May 30, 1990.
