Dear Senator Levin:
I am pleased to provide you with infortnation regarding your letter of April 10, 1990 in which you enclosed a letter from Mr. James K. Middlemas, Sr., of Monroe, Michigan. You asked us to look into Mr. Middlemas' request for the disclosure ofallreportspreparedbytheInstituteofNuclearPowerOperations(INPO)that evaluate the adequacy of operations at the re?mi-2 nuclear power plant.
Following the 1979 accident at the Three Mile Island plant, the 55 utilities owning and operating nuclear power plants joined together to create INP0 as an organization dedicated to upgrading the quality of operations and safety performance at nuclear power plants. One of INP0's primary methods of achieving improved performance is through the conduct of periodic, comprehensive team evaluations at all reactor facilities. During such an evaluation, a team, which typically consists of 10 to 15 persons experienced in all aspects of nuclear operations, spends several weeks at both the plant and the corporate office interviewing the utility staff, examining records, and conducting independent inspections. With the information gathered from these activities, the inspection team provides a written report to the utility, which contains the strengths and weaknesses that the team observed.
The utility is required to report back to INPO on the steps that they plan to take to address the observed weaknesses. Then INPO reviews these items during subsequent evaluation visits.
INPO has taken the position that their reports should not be made public.
By treating the reports as proprietary information, member utilities will feel free to accept and answer condid reports of weaknesses without becoming defensive and argumentative. The NRC has accepted and agreed with this position, especially because we are able to review the reports upon their issuance.
While INPO does not make its evaluation reports public and is not required to submit them to the NRC, our staff reviews these reports onsite at each reactor facility. This review is normally conducted by one of our resident inspectors who is assigned fulltime at each licensed power reactor. The NRC reviews the reports to ensure that they do not contain any significant adverse safety information that was not previously known to us tMCugh our comprehensive inspection program.
In addition, we require every utility to directly notify us of any INPO finding that indicates a condition that the utility's license requires them to report to the NRC.
