Purpose:

To provide the Comission with an annual report regarding the results of investi of Investigations (01)gations completed by the NRC Office

Background:

In a staff requirements memorandum, COMJC-89-8, dated June 30, 1989, entitled " REPORTS ON THE RESULTS OF 01 INVESTIGATIONS," the Comission directed 01 to prepare an annual sumary report of the results of investigations completed by 01. Further, this report should address the number of case referrals to the DepartJnent of Justice (00J), the results of those referrals, sumaries of the general types of allegations investigated, sources of those allegations, the numbers of allec tions substantiated and not substantieted by 01, and the nature of NRC enforcement actions taken as a result of 01 l investigations. Executive i sumary: 01 conducts investigations of alleged wrongdring by in.lividuals or organizations, outside the NRC, who are licensed by the NRC, have applied for NRC licenses, or who are vendors or contractors of NRC licensees. OI is organized into five regionally based Field Offices under a Headquarters element. There were 34 assigned investigators and 10 operational support staff, nationwide, as of December 31, 1989. The average experience of an individual 01 criminal investigator is approximately 20 years, normally in Federal criminal law i enforcement or with the NRC itself. Backgrounds of the

9 i investigators vary), but include the Federal Bureau ofInvestigatil (DEA), the Bureau of Alcohol, Tobacco and Firearns (ATF), the Army Criminal Investigation Connand (USACIDC), the Naval Investigative Service-(NIS), and other Inspector l General offices within the Federal comununity. During calendar year 1989, OI opened 98 new investigations and completed 105 investigations. Those completed investigations are listed on the enclosed Annual Report of Closed Cases for the Period January 1,1989 through i December 31, 1989 (Enclosure 1). They are categorized by major types of alleged wrongdoing offenses as follows: [ I Willful Material False Statements : 67 Willful Intimidation and Harassment (Discrimination and Retaliation): 10 l Willful Violations of NRC License Conditions or the Atomic Energy Act: 24 j Other Willful Violations: 4 l shows these types of willful violations by percentage of the total case load for 1989, based on closed investigations. Enclosure 3 shows a comparison of major types of investigations of willful violations completed by 01 during 1984 through 1989. Of the 105 cases closed in 1989, 44 were closed in the i preliminary investigation' (Inquiry) stage. Of these inquiries, 21 were unsubstantiated, 22 were closed out administrative 1y, primarily for lack of investigative resources, and I was transferred to another region where resources were more readily available. l r Of the 1989 completed investigations 61 went beyond the inquirystageandwarrantedfull-scaleinvestigations. O D 3-substantiated in 35 cases. In 26 instances the 01 full-scale investigation did not substantiate any allegations of wrongdoing. Of the 35 cases in 1989 in which the 01 investigation substantiated allegations of wrongdoing, 10 resulted in significant NRC enforcement action during 1989. Additionally, there were 8 NRC enforcement actions generated in 1989 which resulted from 01 investigations closed in prior years. Of the same 35 substantiated 1989 cases, 26 were referred to D0J. During 1989, 01 supported eight Federal Grand Juries, which resulted in nine indictments. During 1989 there were six convictions in Federal courts as a result of substantiated 01 investigations. Enclosure 4 indicates the number of D0J referrals made by 01 from 1984 through 1989. Significant Cases: As a partial result of an 01: Region I investigation into the destruction of records concerning a safety limit violation by a former licensed operator at Oyster Creek Huclear Generating Station, the Office of Enforcement (DE) issued a Notice of Violation (NOV) and imposed a $50,000 civil penalty against the station owner, General Public Utilities Nuclear Corporation. 01: Region II investigated a former chief of radiology at Humana Hospital who was alleged to have submitted falsified preceptor statements pertaining to an application to become an authorized user of nuclear medicine. As a result of 1.he 01 investigation, and based on a pretrial agreement in Federal court, this individual was placed under supervised probation for 1 year. He also agreed to refrain from employment in any activity licensed by the NRC or any of its agreement states and from the practice of any form of nuclear medicine. 01: Region II investigated a nuclear medical technologist at St. Mary's Hospital who was alleged to have intentionally overdosed four hospital patients with radiopharmaceuticals and to have falsified hospital records to conceal these overdoses. i . of an eight-count Federal indictment and was placed on probation for a period of 5 years. During this time the individual must perform 300 hours of comunity service and pay the cost of supervision of such service, totalling $5,499.60. Additionally, this individual is prohibited from engaging in any type of nuclear medicine during the probationary period. As a result of this case, OE issued an NOV to St. Mary's Hospital and a civil penalty to another hospital where the technologist had been previously employed. 01: Region III investigated a Radiation Safety Officer (RS0) at Bloomington Hospital for allegedly covering up evidence of misadministrations and making false statements to ihe NRC. As a result of this investigation, OE issued an order removing this individual as R50. In addition, the individual pleaded guilty in Federal court on October 2,1989, and was subsequently sentenced to a 2-year period of unsupervised probation, and fined $1,000. 01: Region IV completed an investigation of Midwest Wireline Logging & Perforating, Inc., for false statements to the NRC and failure to post notice on radioactive source material containers. This investigation resulted in a federal indictment of the firm's owner and the owner of a former NRC-licensed firm, Midwestern Wireline Corporation. Both individuals pleaded guilty, were sentenced to 21 years' probation, and fined $2,500 each. OE issued a Notice of Violation and an order suspending the license of Midwest Wireline Logging & Perforating, 7 Inc. ^ 01: Region IV investigated the president of Basin Testing Laboratory for an allegation of intentionally failing to notify the NRC concerning radiographic activities performed in nonagreement states and making false statements to the NRC. As a result of this investigation, OE imposed a civil penalty of $5,000, and issued an order to show cause why the license of Basin Testing Laboratory should not be suspended. This matter is currently being evaluated by the DOJ for prosecutorial perit. 01: Region V investigated the radiographic activities of United States Testing Company, Inc. . States. Several UST radiographers were alleged to have been overexposed while performing licensed activities. The investigation detemined that the radiation safety program was willfully administered in violation of NRC license conditions. The resulting NRC enforcement action, which included an extensive notice of violation and a civil penalty of $280,000, was issued in September 1989. 01: Region V, in cooperation with the NRC Vendor Inspection Branch, conducted a proactive investigation of General Electric Nuclear Energy Division in an effort to determine if counterfeit molded case circuit breakers were being sold and/or distributed within the nuclear industry through the General Electric supply system. The investigation determined that although General Electric policies and practices were generally adequate to protect against counterfeit sales, there were weaknesses within their business practices and distribution system. These identified weaknesses were voluntarily corrected by General Electric. Trends: The graph at Enclosure 5 shows 01 investigations opened from 1984 through 1989. It indicates what appears to be a significant downsurge in cases opened, from 160 in 1984 to 90 in 1986. This is somewhat misleading. There were changes in reactor licensing and regulatory activities during this period of time which likely contributed to a degree to a decrease in average 01 case loads. However, this manifestation is not, in reality, a downsurge. It is more accurately described as a return to normal in average case load from a period in 1984 and 1985 in which the number of cases opened was unusually high. To be nore specific, the following events impacted on average case loads of the individual 01 Field Offices during this period: OI: Region I increased its nomal case load by nearly 50% in 1984 due to investigations initiated at Nine Mile Point I and 2, and Three Mile Island 2. 01: Region IV more than doubled its nomal case load in 1984 due to an increase in employee concern cases at Comanche Peak 1, Wolf Creek 1, and Waterford 3. . OI: Region Y doubled its normal case load in 1984 and tripled it in 1985 due to an increase in investigations conducted at Diablo Canyon 1, San Onofre 1 and Palo Verde 1. OI: Region II approximately doubled its normal case load in 1985 due to an unusually large number of investigations involving TVA. t 01: Region IV experienced a significant decrease in cases initiated in 1986 from previous years due to the transfer of the Vendor Inspection Program in 1985 from Region IV to NRC Headquarters. The graph at Enclosure 5 can also be seen to demonstrate that this general leveling off of investigations opened, which began in 1986, continued through 1989. There was an average number of 90 investigations opened by 01 during this 4-year period, which is consistent with the NRC Five-Year Plan. This further equates to an average of 19 cases opened per regional 01 Field Office per year during this same 4-year period. shows the number of 01 cases closed for the period from 1984 through 1989, indicating a modest downward trend. The average number of cases closed is 114 per year from 1984 through 1989. Regarding trends in the types of willful violations investigated by 01 over recent years, reference is again made to the graph at Enclosure 2, which compares major types of investigations completed by 01 from 1984 through 1989. Clearly, investigations of willful material false statements have dominated the wrongdoing arena for the past several years, and the number of such investigations completed per year has demonstrated a generally upward trend. Until the last 2 years, investigations into alleged discrimination and retaliation for surfacing safety concerns, commonly referred to as " intimidation and harassment" (I&H) cases, were responsible for the second largest nurber of 01 investigations completed. Such I&H investigations have continually exhibited a general decline in number. m ] e 7-Act. This decline in I&H investigations closed is i essentially paralleled by the number of such investigations opened during the same years. It is believed to be a result of the decrease in construction contractors, workers, and activities at plant sites. Since 1986, there has been a steady increase in the number of irvestigations completed in the category of willful violations of license conditions and/or the Atomic Energy Act. This upward trend can be accounted for, at least in part, by the increase in the r: umber of plants coming on line since 1986. According to 01 statistics, the nurber of product substitution fraud investigations has gradually increased over the past few years. During calendar year 1989, 01 focused much of its attention on the sale to nuclear power plants of counterfeit and/or substandard parts, such as j fasteners, flanges, valves, fuses, piping, and circuit breakers. 01 efforts in 1989 resulted in the return of multiple-count Federal indictments in the Northern District of Texas and Southern District of Illinois. In addition, Region V investigations involving the execution of criminal search warrants which occurred in 1988 continued throughout 1989. Initiatives: In an effort to provide to 01's customers, the NRC decision makers, the best possible product in the most expeditious manner, 01 has implemented several management initiatives targeting on oversight and timeliness. In 1989, 01 formalized a program of periodic Headquarters visits to the five Field Offices to conduct programatic and operational oversight. These visits focus on overall programatic compliance, office management, investigative case management, thoroughness, and timeliness. In addition to the regional assistance visits, 01 has effected several changes in the Investigative Procedures Manual to improve the reliability of estimated dates for completing investigations, the timeliness of initial interviews of allegers, the timeliness of report writing, the efficiency of case review at both the Field Office and Headquarters, and the number of high priority investigations conducted by investigators simultaneously. , As an essential adjunct to these attempts to improve overall efficiency, 01 comenced, in 1989, a major revision and streamlining of the investigative report forcat, which should be in effect in 1990. In keeping with the NRC Five-Year Plan, all of the above described steps have been aimed at improving the efficiency of the 01 operation and have reduced the backlog of investigations. Forecast: The Office of Investigations will monitor timeliness and oversight improvements over the coming year and adjust as warranted. It is anticipated that the revised and streamlined investigative reporting format will be in place during the coming year. In cddition, 01 has scheduled a meeting in approximately mid-1990 of all investigative staff, with a primary goal of coordinating and f acilitating the rapid implementation of this revised report format. These factors alone are expected to improve the overall timeliness of our product reaching its intended customers, and further reduce the backlog of investigations, in keeping with the NRC five-Year Plan. In the coming year, in conjunction with the Office of the Inspector General and the Office of the General Counsel, 0! will develop and implement an improved program for handling confidential informants / sources. It is apparent that the nuclear industry over the past 2 years has become increasingly more sensitive to the important safety issue of substandard or counterfeit products infiltrating nuclear plants. Initiatives initially undertaken by HRC to coordinate efforts intergovernmentally in the product fraud area continued throughout 1989. In 1990, 01 will work closely with the NRC Yendor Inspection Branch, as well as with the investigative agencies of Department of Defense, the National Aeronautics and Space Administration, and the U.S. Customs Service, with a view toward a consolidated effort, Government-wide, to diminish the product fraud threat. It is projected that product substitution fraud cases will exhibit a gradual increase into 1990. i - i it is anticipated that the number of investigations of this sort will level off and ultimately decrease. l It is expected that the current trends in types of willful violations investigated by 01 will prevail in 1990. The primary violation investigated by 01 will continue to be alleged willful material false statements. It is forecast that intimidation and harassment cases will continue to decline, but may level off cr even rise I somewhat as more backfitting becomes necessary at nuclear i plants and construction contractors are brought on board.
