Dear Senator Simon:
I am responding to your letter of March 13, 1990, in which you forwarded an inquiry from your constituent, Mrs. Marlene Mertes, concerning an investigation program that had been implemented at the LaSalle County Station that includes an indepth background investigation.
We understand that the Commonwealth Edison Company, the utility that operates the plant at which your constituent is employed, has changed several access requirements at its six nuclear sites.
One change involves the use of the
" Industry Guideline for Nuclear Power Plant Access Authorization Programs" (NUMARC 89-01), published by the Nuclear Management and Resources Council, Inc.
Use of these guidelines fulfill applicable parts of NRC requirements in the Code of Federal Regulations, Title 10 CFR 73.55(d), to provide for unescorted access by indivicNals at a licensee's facility.
Please note that this screening is intended for granting unescorted access to the facility and not for measuring an individual's work performance.
Commonwealth Edison Company is also standardizing background data for this access authorization program and for implementing the employment history requirements of NRC's fitness-for-duty rule (10 CFR Part 26). The utility's program changes are intended to establish a consistent data base to facilitate exchange of background information and apply to all contractor employees and newly hired Comonwealth Edison personnel. This should expedite future processing of contractor access at nuclear power plant sites.
Comonwealth Edison has a policy of informing any employee or contractor denied access to a facility the reason for denial; an appeal process is also provided.
Access to records is not routinely provided. Anonymous complaints regarding the conduct of background investigations may be addressed to the Corporate Director of Security, Mr. Patrick Laird, Post Office Box 767, Chicago, Illinois 60690. He has a staff dedicated to reviewing such concerns.
The NRC has informed Mr. Laird's staff of the substance of your constituent's complaint.
