1 Your letter of February 24, 1990, to President Bush was referred to our Agency for action.
In your letter you expressed concern about the proposed low-level l
radioactive waste facility to be located in Michigan and suggested that this radioactive waste be disposed of in an area where no one lives such as a l
desert, Alaska or the Grand Canyon.
l As background, Michigan was selected by the Midwest Compact to be the Host State for a low-level radioactive waste disposal facility under the provisions of the Low-Level Radioactive Waste Policy Act of 1980, as amended.
In the late 1970's, the U. S. Congress initially considered a Federally oriented solution to the problem of assuring adequate low-level waste disposal capacity for the i
nation. Eventually, however, in response to policy recommendations from State-supported organizations, including the National Governor's Association and the National Conference of State Legislatures, the Low-Level Radioactive Waste Policy Act of 1980 was enacted.
i The 1980 Act made each State responsible for providing disposa1' capacity for low-level radioactive wastes generated within its border.
It encouraged States to form regional compacts to collectively meet their obligations to provide for disposal capacity, and allowed those compacts ratified by Congress to exclude waste generated outside their borders. The Midwest Compact includes the States of Indiana, Iowa, Michigan, Minnesota, Missouri, Ohio and Wisconsin. Michigan

was selected as the Host State for a low-level nuclear waste facility by the-l Midwest Compact member States and is designated to accept the low-level i
radioactive waste generated within the seven States. A diagram showing all of the low-level radioactive waste compacts is enclosed.
Once any Host State has selected a potential low-level waste disposal site, the State or its developer must submit a. license application to the Nuclear Regulatory Commission (NRC) or a State licensing authority with'a program equivalent to that of the NRC for a licensing decision. Part 61 of Title 10 of the Code of Federal Regulations includes licensing procedures that were developeo by the Nuclear Regulatory Commission expressly to assure that all potential health and safety and environmental impact questions are reviewed. It specifies requirements at each of the critical steps in the lifecycle of the site to ensure that public health and safety are protected, f
