PROPOSED IMPOSITION OF CIVlt PENALTY - $75,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $75,000 will be issued on or about April 12, 1990 to Tennessee Valley Authority.
This action is based on the failure to adequately evaluate and correct a design deficiency at Sequoyah relating to the susceptibility of RHR pump deadheading during miniflow condi-tions, as discussed in NRC Bulletin 88-04.
The licensee failed to take adequate corrective action to preclude pump damage should deadheading develop.
Additionally, the licensee failed to adequately evaluate test data which demonstrated that deadheading would occur.
This resulted in inaccurate information being reported in response to the Bulletin request.
The civil penalty was escalated 50% because the NRC identified the violations.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice April 12, 1990 Tclephone Notification of Licensee April 12, 1990 The State of Tennessee will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
