IMPOSITION OF CIVIL PENALTY - $50,000 By EN 89-114 dated December 19, 1989 the Commission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in t
the amount of $50,000 to Consolidated Edison Company. This action was based on a violation involving a revision to the licensee's emergency plan which would have lowered the Emergency Action Level classification of certain events from what they would have'been classified under the licensee's approved emergency plan.
The licensee responded to the Notice in a letter dated January 25, 1990. After careful consideration of the licensee's response, the staff has concluded that t
the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty and the licensee did not provide an adequate basis for reduction of the Severity Level or mitigation of the civil penalty.
Accordingly, an Order Imposing Civil Penalty in the amount of $50 000 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
