Dear Mr. McLaughlin:
Thank you for your letter of January 11, 1990, in which you informed this office of the results of recent radioactive contamination measurements that the University staff performed on the 22 concrete shielding blocks donated to the Wildlife Waystation of San Fernando, California.
In the enclosure to your letter, you note the problems inherent in the use of disintegrations per minute (dpm) to measure for radioactive contamination.
While we acknowledge these problems, dpm measurements are required by 10 CFR 20.401 and 20.5.
Using dpm measurements and applying the most conservative assumptions to your data, we agree with your conclusion that block C-5 satisfies the criteria for unrestricted use that were established by the NRC's Atomic Safety and Licensing Board as part of the Settlement Agreement between the University, the Committee to Bridge the Gap, and the NRC staff.
Your actions will be verified during a future inspection.
