i MASS AG'S ADVICE TO THE COMMISSION Through reading CLI-90-03, dated March 1, 1990 it came to the

attention of this office that a major typographical error was made in an earlier pleading filed by this office with the Commission.

In

CLI-90-03 at 61 of the Slip Opinion the Commission states:

Intervenors' further assertion that Applicants' financial i

condition will leave them unable to meet decommissioning expenses in the event a license is ultimataly vacated totally lacks substance.

They claim that the Aeolicants would have no more than $43 million available at the end of the first year from the state fundina source for decommissionina and could have nothina from NRC fundina.

Intervenors are mistaken..

In tracing the source of the Commission's belief that Intervenors claim that $43 million would be available for decommissioning ~in the first year of operation, it came to light that that source was "Intervenors' Application for a Stay of.LBP-89-32" at page 9.

's The key sentence states:

"Should premature decommissioning occur only 43 million (out of total decommissioning cost assumption of $242 million) would be available in the first year from the state fundin very likely no money from the NRC funding source.g source and That sentence omitted a key decimal point.

It should have read "4.3 million" not "43 million".

As shown in Exhibit 1 attached to that pleading, the source of that figure was derived from the "New Hampshire Yankee Decommissioning Fund Funding Schedule."

The specific figure that is the source for the "$4.3 million" is

$4,292,713 found at the top of the column of figures labelled " Fund Balance at Year End" at Exhibit 1-B.

When the pleading in question was typed and proofed the lack of the decimal point went unnoticed.

i It was only in' reading the Commission's decision that the typographical area came to light.

This office regrets the typographical error and any confusion that may have been caused by 10.
