ORDER We have before us the February 28, 1990 Emergency Motion-of the Intervenors to Reopen the-Record, for Summary
-Disposition as to the Need for Sheltering in Certain l
Circumstances and for License Revocation.
The motion recites-.in a footnote that, out of an abundance of caution, it has also been filed with the Commission and the Licensing
. Board.
More specifically, this-action was prompted by our
[
February 14, 1990 order raising a question as to our jurisdictica to consider a February 6, 1990 motion of intervenors that likewise sought a reopening of the record in this operating license proceeding to consider the need 1
for sheltering in certain circumstances.
We now conclude that the Licensing Board is the l
l appropriate forum to deal with both motions insofar as they l

deal 2with reopening the record on sheltering matters.1 No such matters are now in our hands.
In contrast, by reason 2
.of'the remand ordered in ALAB-924, the Licensing Board currently does have sheltering issues within its domain.3 We recognize that both applicants and intervenors have filed with the Commission petitions for review of ALAB-924.
l The Commission has, however, neither acted on those petitions nor stayed the effectiveness of ALAB-924 pendente lite.
If the Commission nonetheless desires to pass itself
'in the first instance on the pending motions to reopen, it is, of course, free to advise the Licensing Board to withhold action on them.

The February 6 and 28, 1990 reopening motions of the i
intervenors are referred to the Licensing Board for consideration and disposition.4 The February 6 motion also requested clarification of 1
the status of a pending appeal.
We will deal with that
