APPENDIX A NOTICE OF VIOLATION Combustion Engineering, Inc.

During an inspection conducted on November 27-30, 1989, a violation of NRC requirements was identified.
In accordance with the " General Statement of Policy and_ Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (Enforcement Policy, 1988),
the violation is set forth below.

Section 4.3.19, " Specific Criticality Safety Criteria", of Part 1, Criteria,- of the NRC-approved license application for License No. SNM-'1067 states, iri part, that shipping container arrays of different types shall be separated from one another by at least 20 feet.
Contrary to the above, on November 28, 1989, different shipping container arrays were not separated by 20 feet in that an array of Model CE-250-2 shipping containers holding scrap uranium residuals'in a storage trailer was located within 19 feet of an array of Model 927 shipping containers holding fuel assemblies.
This is a. Severity Level IV Violation-(Supplement VI D)
Pursuant to the provisions of 10 CFR 2.201, Combustion Engineering, is hereby required to submit to this office within thirty days of the date of the letter which transmitted this Notice, a written statement or explanation in reply, including: (1) the corrective steps which have been taken and the results
- achieved; (2) corrective steps which will be taken to avoid further violations;.
and (3).the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
