We are in receipt of your letter dated February 12, 1990,-and'the
enclosed notice of violation regarding- Raba-Kistner Consultants
Inc.
(R-KCI) use of. radioactive materials contained in nuclear
As required by the Nuclear Regulatory

Commission,.we are providing herein our written response to this
notice of. violation.
Members of our;El Paso staff did use nuclear moisture-density
. gauges at - White sands Missile Range and Fort. Bliss during the
calendar years 1988 and 1989 without prior notification to - the
Nuclear Regulatory Commission.
Our-El Paso staff was1 unaware of
.this. requirement at the time these activities took place.
Since
this . . requirement has - been brought to our attention,
we have
submitted NRC- form 241 to the Nuclear Regulatory Commission office
in Arlington, Texas.
It is our understanding this allows us to
operate.on, military bases ~for a period not to exceed 180 calendar
' days .during the
calendar year.
We
have also made
formal
application for a corporate Nuclear Regulatory Commission license.
We anticipate approval of this license application not later than
' April 1990.

This refers to the routine, unannounced radiation safety inspection conducted

by Mr. Anthony D. Gaines of'this office on January 22 and 30, 1990, of the-
'
activities authorized by a General License in accordance with 10 CFR 150.20,
and to the discussion of our findings held by the inspector with
Mr. D. C. Yount at the conclusion of the inspection.
!
The inspection was an examination of the activities conducted under the license
as they relate to compliance with the Commission's rules and regulations and
-the conditions of the license. The inspection consisted of a personal
'
interview with Raba-Kistner Consultants, Inc.'s, corporate radiation safety
officer in. San Antonio, Texas, and a telephone interview with Mr. Yount of your
. staff.
During this inspection, certain of your activities were found not to be
conducted in full compliance with NRC requirements. Consequently, you are
required to respond to this matter in writing, in accordance with the
provisions of,Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10,
Code of Federal Regulations. Your response should be based on the specifics
-
contained in the Notice of Violation enclosed with this letter.
-
-The response directed by this letter and the accompanying Notice is not subject
to the clearance procedures of the Office of Management and Budget as required
by the Paperwork Reduction Act of 1980 PL 96-511.
This letter also acknowledges receipt of NRC Form 241, which you submitted to
report proposed activities in non-Agreement States under the authority of the
general license pursuant to 10 CFR 150.20.

~Your Agreemen't State license is recognized as valid for the uses in your
submittal dat'ed January 23, 1990.
Please note that the NRC does not regulate
the use-of radium-226.

During an NRC inspection conducted on January 22 and 30, 1990, a violation of
NRC requirements was identified.
In accordance with the " General Statement of
Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2. Appendix C
(1989) (Enforcement Policy), the violation is listed below:
10 CFR 150.20(b)(1) requires that, prior to engaging in activities in
non-Agreement States under the general license granted by

10 CFR 150.20(a), notification be made to the Nuclear Regulatory
'
Commission.
.
Contrary to the above, in 1988 and 1989, the licensee used
moisture / density. gauges containing byproduct material at White Sands
Missile Range and at Fort Bliss,'both of which are federal facilities,
s
without making the required notification.
This is a Severity Level IV violation.

Pursuant to the provisions of 10 CFR 2.201, Raba-Kistner Consultants, Inc., is-

hereby required to submit to this office, within 30 days of the date of the
letter transmitting this Notice, a written ststement or explanation in reply,
including for each violation: (1) the reason for the violation if admitted,
,
(2) the corrective steps which have been taken and the results achieved,
'
(3) the corrective steps which will be taken to avoid feirther violations, and
/
(4) the date when. full compliance will be achieved. Where-good cause is shown
'
consideration will be given to extending the response time.
