APPENDIX A NOTICE OF VIOLATION Steven A. Artz, M.D.

License No. 47-16156-01 As a result of the inspection conducted on September 15, 1981, and in accordar.ce with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980), the following violations were identified.

A.

10 CFR 20.105 requires that no licensee shall possess or use licensed material in such a manner as to create in any unrestricted area from radioactive material in his possession radiation levels which, if an individual were continuously present in the area, could result in his receiving a dose in excess of 100 millirems in any seven consecutive days.

Contrary to the above, on September 15, 1981, the day of the inspection, radiation levels of 1.5 millirems per hour were measured in an unrestricted examination room adjacent to your Nuclear Medicine Laboratory.

These radiation levels would result in a dose of 252 millirem in seven consecutive days.

This is a Severity Level IV Violation (supplement IV).

B.

10 CFR 20.201(b) requires each licensee to make such surveys as may be necessary for him to comply with the regulations in this part.

Contrary to the above, on September 15, 1981, surveys were not performed in an examination room adjacent to your Nuclear Medicine Lab to assure compliance with 10 CFR 20.105, " Permissible levels of radiation in unre-stricted areas".

This is a-Severity Level V Violation (Supplement IV).

C.

License Condition 15 requires that licensed material be used in accordance with statements and procedures contained in your letter dated November 27, 1979.

One procedure in ' your letter of. November 27, 1979, requires the performance of weekly contamination surveys.

Contrary to the above, the requirement to perform weekly _ contamination surveys was not met in ~ that contamination surveys are not routinely conducted on a weekly basis.

This is a Severity Level'V Violation (Supplement-VII).

2 License No. 47-16156-01 Pursuant to the provisions of 10 CFR 2.201, you are hereby required to submit to this office within thirty days of the date of this Notice, a written statement or explanation in reply.. including: (1) admission or denial of the alleged viola-tions; (2) the reaso.: for the violations if admitted; (3) the corrective steps which have been taken and the results achieved; (4) corrective steps which will be taken to avoid further violations; and (5) the date when full compliance will be ach.eved. Consideration may be given to extending your response time for good cause shown. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.

The responses directed by t.nis Notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
