LILCO SUPPLEMENT TO RECENT S,TATUS REPORTS OF THE COUNTY AND STAFF On October 6, 1981, LILCO filed " Applicant's Motion D
that a Hearing Schedule Be Set."
The first of many deadlines proposed in that motion was November 4, 1981, on which:
All parties (were] to file their final positions on contentions, eithet (1) agreeing on a list of particularized issues to be litigated further in the proceeding or (2) stating their disagreements (which were to be resolved thereafter by Board order].
On November 6, 1981, the Board denied by telegram LILCO's October 6 motion.
The telegram stated:
Applicant's Motion to Establish Hearing Schedule is denied.
Suffolk County shall report status of legislative action of sixth stipulation by November 25.
Staff shall advise by November 25 when open items in SSER and ACRS letter will be closed.
Confirmation will follow in order.

Proposed Sixth Stipulation As finally negotiated by representatives of LILCO, the NRC Staff and Suffolk County,1! the proposed Sixth Stipulation consists of thirty-one pages of finely dr:wn agreements.
It was drafted after extensive effort and significant compromises on the part of both LILCO and the County.
On October 13, 1981, LILCO's Chairman and Chief Executive Officer wrote the County Executive as follows:
I am pleased to advise that the proposed Sixth Stipulation and Settlement of Suffolk County Contentions in the Shoreham Nuclear Power Station Operating License proceeding j
before the Nuclear Regulatory Commission, Docket 50-322, has been reviewed by me and other officials of the Long Island Lighting Company.
As a result of such review, I am prepared to recommend to the Board of Directors of the Company that the Board au-thorize execution of this document by the uppropriate representatives of the Company once it has finally-been approved by you and the County Legislature and executed on behalf of the County.
I would like to take this opportunity to l
thank you, the County Attorney's office and other officials of Suffolk County, particu-larly Legislators Blass and Pt rizzo, for the efforts of each in reaching a satisfactory solution to a most difficult problem.

The County Executive has indicated its satisfaction I
with the agreement as negotiated.
The County Legislature, how-ever, has yet to vote on it, declining to do so most recently on November 24.
Amendments to the agreement have also been proposed by various legislators.

The County's negotiators included representatives of both the County Executive and the County Legislature.

amendments, if adopted, would materially change its terms.
Thus, there is no assurance that a Sixth Stipulation will be approved by the Legislature, or, if approved, that the result-ing document will sufficiently resemble the previously negotia-ted agreement to be acceptable to all parties.
Open Items There remain certain open items in the Staff's review of Shoreham.
With rare exception, some open items always exist when operating license hearings begin.
The relevant questions are whether (1) such open items concern any of the contentions to be litigated and (2), if so, whether the Staff is prepared nonetheless to file testimony on the affected contention (s) prior to issuance of an SER supplement covering them.
Schedule LILCO looks forward to the order referenced in the Board's November 4 telegram.
The Applicant remains intensely interested that the Board set a schedule for the balance of this proceeding, now well into its fifth year.
