POWER AUTHORITY'S MOTION TO EXCLUDE FEAR OF NUCLEAR POWER AS AN ISSUE IN THIS PROCEEDING This motion is filed by the Power Authority of the State of New York (Authority), licensee of Indian Point Unit 3.
The Authority requests that this Atomic Safety and Licensing Board (Board) exclude from this proceeding the iscue of fear of nuclear power.
The Board should exclude the issue of fear, based upon the following grounds which are fully set forth in the licensee's supporting Memorandum of Law and the Affidavit of Dr. Robert L.
DuPont, incorporated herein by reference:
(1) prospective intervenors who exacerbate fears of nuclear power are estopped frcm introducing that issue, and (2) consideration of the issue of irrational fear of nuclear 3
