The Comission discussed with staff the proposed ' amendments to rules of practice governing discovery, as contained in a memorandum from B. Cotter dated October 29, 1981.
The Comission requested:
1.
that references to Section 2.740b(c) be corrected; 2.
that the General Counsel insure consistency between Sections 2.740 and 2.720; 3.
that th~e General Counsel should discuss whether the rules should be revised to encourage greater use of depositions; 4.
that alternate language proposals be developed for Section 2.740b(c) as discussed at the meeting; 5.
that the General Counsel submit a memorandum for Comission consideration, discussing the three policy issues he described at the meeting.
The Conraission requested that a new proposal with the modifications cited above, be circulated for Comissioner approval by notation vote.
