1 ApPEflDIX A fl0TICE OF VIOLATI0ff Pacific Soils Engineering & Testing License fio. 54-19242-01 P. O. Box 8453 Tamuning, Guam 96911 As a result of the inspection conducted September 25, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7,1980), the following violations were identified:

A.

10 CFR 20.203(e) requires that each area or room in which licensed material is used or stored and which contains any radioactive material (other than natural uranium or thoriun) in an amount exceeding 10 times the quantity of such material specified in Appendix C of this part shall be conspicuously posted with a sign or signs bearing the radiation caution symbol and the words: CAUTI0ftRADI0ACTIVEMATERIAL(S)

Contrary to the above requirement, at the time of the inspection, the room / area in which the Troxler Model 3411D moisture density gauge, Serial flo. 7261, was stored, was not posted. The gauge contains millicurie quantities of licensed material.

This is a Severity Level IV Violation.

(Supplement VII)

B.

License Condition 14.A(1) requires that each sealed source containing licensed material, other than hydrogen-3, with a half life greater than thirty days and in any form other than gas shall be tested for leakage and.contanination at intervals not to exceed six months.

Contrary to the above requirement, at the time of the inspection, the sealed sources contained in the Troxler Model 3411B, Serial fiumber 7261, had not been leak tested since August 7, 1980.

This is a Severity Level IV Violation.

C.

License Condition 17 requires that except as specifically provided otherwise by this license, the licensee shall possess and use licensed natorial in accordance with statements, representations, and procedures contained in application dated flovenber 15, 1979 as arended by letter dated April 11, 1980. Section 12 of the application states that monthly film badges will be used for personnel nonitoring.

a Contrary to the above requirement, film badge monitoring was not initiated until July 1,1981. A licensee representative stated that the gauge had been used several times during the period of May, 1981 to. July 1, 1981.

This is a Severity Level IV Violation.

D.

10 CFR 19.11(a) requires that each licensee shall post current copies of the followino documents:

(1) 10 CFR 19 and 20; (2) the license, license conditions, or documents incorporated into a license by reference, and anendments thereto; and (3) the operating procedures applicable to the licensed activities. 10 CFR 19.11(b) states that if posting a document specified in 10 CFR 19.ll(a) is not practicable, the licensee may post a notice which describes the document and states where it may be examined.

Contrary to the above requirement, at the time of the inspection, neither the posting of the documents required by 10 CFR 19.ll(a) nor th* notice authorized by 10 CFR 19.11(b) to indicate where the docunents are available for examination were being maintained.

This is a Severity Level V Violation.

E.

License Condition 15 requires that a physical inventory be conducted every six nonths to account for all sealed sources received and possessed by the licensee, and that records of the inventories be maintained for two years from the date of the inventory for inspection by the Comission.

Contrary to the above requirements, at the time of the inspection, semiannual physical inventories had not been conducted during the period from August 17, 1930 to September 25, 1981.

This is a Severity Level VI Violation.

Pursuant to the provisions of 10 CFR 2.201, Pacific Soils Engineering &

Testing is hereby required to sutait to this office within thirty days of the date of this Notice, a written statement or explanation in reply, including:

(i) the corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further items of noncompliance; and (3) the date when full cenpliance will be achieved.

Consideration may be given to extending your response time for good cause shown.

a o The responses directed by this notice are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
