This action is based on alleged violations relating to the
~
misuse of personnel monitoring devices by a licensee contractor.
The most serious concern is that managernent control of the radiation protection program was not adequte to provide reasonable assurance that contractor personnel exposures would be maintained within the exposure limits of 10 CFR Part 20.
Contrary to the licensee's radiation protection program procedures, contractor workers and supervisors manipulated their use of personnel dosimeters on several occasions to prevent the correct recording of their occupational radiation exposure.
A news release has been prepared and will be issued following licensee notification.
The State of New York will be notified.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:

Following NRC staff evaluation of the response, the civil penalties may be remitted, mitigated or imposed by Order.
